was that wheu plaintiffs sold their tobacco
they signed a contract, in which the prices
they were te receive for the several grades
were stipulated, and it also set forth hew
the tobacco was te be asserted. When tbe
tobacco was deliveced it was observed by
the defendants that the tobaeoo was net
properly asserted and that there were
white vein leaves among the wrappers and
they refused te reoeivo the tobaeoo. After
some conversation between the parties a
new contract was made by which phintiff
were te receive 20 eents per pound for first
wrapper, 10 cents per pound for wbite vein
wrappers, Bhert wrappers and soeonds.
The tobacco was weigbrd and plaintiffs
received a check for 81,010.33 That
amount, the defendants elaim, was in full
for tbe tobacco.
Tte jury renderfd a verdict in favor of
plaintiff for $233, the full amount of the
elaim with interest.
In theisuit of Jehn II. Gibsen vs. The
Dlebeldjpafe and Loek Ce., defendants, and
Ezra FJuewman, gnrmsnoe, platetlU suf
fered a lien suit.
There wcre no ethor eases ready for trial
and tbe jurors were discharged.
