LANCASTER DAILY INTELLIGENCER. MONDAY, FEBRUARY 12, lp$V. DEMOCRATIC PRIMARIES aUiniNATIUMS D f-ATIIKlJAYEVENlMG Hlttr--rd Contest!- In fvent: e: the Wrd 'A Large Vete I'ellcil IIia Jtyeturns Ker Scheel Director. The Democratic primaries were held in the (several ward seu Saturday evening, and despite tlie inclemency of the weather and the fact that in some waids there was no contest, the poll was large. In the First waid a slight centcht for assessor gave some zest te the primary, and after an Atithely lioed naturcd struggle. M. W. Raul was successful eer David Reese. In the Second, Tliiid, Feiutb, Filth aud Sixth waids, there whs very little contest, though a fair vote was polled in all of them, in the Seventh there was a huaip .stiuggle which excited interest all ever the city. A very persistent eiFert was made te heat Select Councilman Gee. M. lierger and Common Councilman Fiank K Eveits, but it failed. In the Eighth then: were numerous candidates for all the offices and a. big vote came out. Geed feeling prevailed and the winner:; had decided majorities. In the Ninth constable and assessor were the places most contested for, and Herr aud Scheet.. n-spectively, weie successful. Fer school duecter, as usual, there were numerous candidates and a geed deal of random and i-cattc-ring voting. Of the old litecters II. Z Kheads declined renomina renemina renomina lieu ; Messrs. .McCouemy, Lcvergoed aud Oblunder were icuumiuated by very com plimentary votes Against Gee. W. Zecher and F. W. Haas some onpesition developed and by slender majorities they were defeated by Win. Jehnsen aud Jehn Ochs. D. iM. McCormiek developed uuex jiectcd strength as a candidate aud was elected by a very large vote. While there was an abundance of geed material te c'joesc from and some disappointment is of course felt, the result as a whole gives geed satisfaction. Under the distribution of Dciuoeiatic school directors as fixed by the nominations of Saturday evening the First, Second, Filth, Sixth, Seventh and Ninth wauls each will have two. the Third and Eighth, each, one and the Fourth four, but in explanation of this it is sug gested that Mr. J. M. Jehnsen, who has since removed into the Fourth ward, was elected fiem the third and that Dr. Mc Mc Cetmick resides almost en the line of the Eighth and was elected by its vote. The name of Charles Iiicg,ef the Eighth ward, who was voted for as a candidate for school director was uevcr sent te this office nor te the chairman of the city com mittee te be printed en the tickets. In 1845 William Miller was a soldier in the army of the king of Wurtemberg. In that country soldiers were net permitted te many. Nevertheless, William Miller became very much attached te a comely German girl named Wilhelmina Arldtt. The attachment was reciprocated, and, as a result, there was born te them en July 18, 1S45, a seu, whom they named after the father, William Miller. Iq 1853, hav iug performed the service claimed te be due te his king, William Miller came te America, bi ingiug with him Wilhelmina Ailett aud their child. They settled iu the city of Lancaster, Pa. Here, en June 2S, 1854, William Miller fulfilled th premise he h:A made Wilhelmina, aud was duly and lawfully married te hei. They never had any children born te them save the son named, born before the marriaee ceremony was performed. In 1853 William Miller renounced his al.'e giauce te the king of Wurtemberg, and became a citizen of the Uuited States. There is a statute of the kingdom of Wuitemburir. passed iu 1010 aud still'iii force, providing that children born out of wcdli ck are legitimate by the subsequent marriage of the parents, and that their rights as regards inheritance from their parents, brothers aud sisters, aud ether relatives shall therefore be held equal te these children who are bera in lawful wedlock. Pennsylvania also has a similar statute, passed in 1857, setting forth that " in any and every case where the father aud mother of an illegitimate child or children shall enter into bends of lawful wedlock and cohabit, such child or child ren shall thereby become legitimate aud enjoy all the rights and privileges as if they had been born during wedlock." A statute of this statu reads : " Children and relatives who are illegitimate shall net be intitlcd te inherit ;" and such has always heretofore been the law in New Yerk. William Miller, by his marriage, did all he could te remove the stain, if there was any stain testing upon his son. In 18G0 he ciima with his family te this city aud engaged in the hotel business. He was very successful, aud amassed considerable property. One piece of laud of which he became possessed is a comer let, 15 J by 30 feet, opposite the station of the New Yerk, Lake Erie and Western railroad cempauy. Upen it new stand the large brick buildings of the Tiega coal company, both owned by the New Yerk, Lake Erie co Western railroad company. It is a very valuable piece cf property. On this spot William lVIiller conducted a hotel aud res tauraut for a number of years. His wife, Wilheimiua, the mother of his seu, died in 1873 and about two years thereafter he married again, his second wile being named Christina, Ne children were born te him by this second marriage. Iu 187G William Miller himself died, aud without making a will. William Mil ler, the son, then and still a resident of Lan caster, Pa., thereupon laid claim te the rea'i estate which his father owned at the time el his death. Christiana Miller, the "widow, resisted this claim en the ground that AVilliam Miller was an illegitimate son. and, by the statutes of this state, could net inherit the property. It was contended that three sisters of William Miller, deceased, residents of this city, were the rightful heirs. A suit was begun in the latter part of 187(! by William Miller for the possession of the property. It was tried by a roieree when the above facts were established, the decision being that William Miller could net inherit. The case was taken te the neueial term of the supreme court, where the decision of the referee was affirmed. It then went te the court of appeals, and its decision was handed down en Tuesday last. It reversed the decisions of the relerrce aud the general term, aud gives the yeuug mau the right te the possessiou of the property which his father owned at the time of his death. This is an entiie change of the law that has been in operation in this state ever since it was a state, aud has excited much interest and comment ail through this region. A bill has been introduced in the Legislat.us by Assemblyman Peuchar reaciiiug the same end attained by the decision of the court of appeals, and there is au important case in New lerk new, in which the possession of a large ameuut of property is at issue en the same point. Se much of this story as makes the claimant still a resident of this city is an error. Eds. Intklmgkxcek Sale el Stevltri.
