Times. The Sbarpsville railroad is a little line in Mercer county, but it is a valuable property, tapping extensive coal fields and is a ieeder of consideiable importance te the threujrh lines. Fer a long time the Eric and Pittsburgh company had a men opely of the coal trade from the Sharps uillf mad and made a poed thinsr of it. Se plump was the plum that the desire te possess it broke up the happy family arrangement that had existed among the stockholders, and two factions, each wealthy and determined, were formed. At the head of one hct was William L. Scott, the well-known capitalist of Erie. The ether side was led by Walter Tierce, the representative of large financial interests. Mr. Scott is the proprietor of large decks at Erie aud Girard and he wanted the Erie and Pittsburgh te carry the Shaips Shaips ville coal te these decks. The Pierce fac tion, en the etner hand, were op posed te the Erie and Pittsburgh -rid threw the coal te the New Yerk, Pennsylvania aud Ohie, and te the Lake Shere. With this state of affans uxifcting the aunual election was held en Wednesday last. The capital stock of the Sbarpsville read is divided into 7,000 shares. Of these the Pierce faction held 3,500 shares, but 410 of them Lad becu transferred within hixtv diys befere the election and could net be voted. The Scott faction mustered o,e00 shares, but they had the judges of election en their side, and that is an important factor when any question of a judicial nature arieCh. The Pierce men, knowing that they would he outvoted, although really owning a majority of the stock, determined te adept the cumulative plan, se iustcad of putting up six candidates for directors, they cast a cumulative ballet for men. The Scott men never dreamed of this litt'.e game aud cast a straight ballet. The Pierce men, with their cumu lative pole, knocked the persimmons, but "the tellers were men who wero the Scott badge, and they decided that the cumula tive plan was net legal. The Pierce vote was accordingly thrown out aud the Scott beard declared elected. Tiu Pierce men had no idea of submitting, aud as soeu as theelectietr was ever the lour candidates met and ergaui.cd as the berd of directors of theSliaipville railroad. The two va cancies in the be.ud were filled, and im mediate steps taken te bring the powers of the law te bear opposition. Tue mandamus was granted and the Scitt di nasty with out delay get out aud the Pierce rru'u took possessierr of the nud, Wallace Pierce as suming the poeition el general manager. While the Scott men did net make any fight, it does net lollew that the trouble is ever. On the contrary, it has net begun. When the tellei.s ei the election refused te recoi'iiize the cumulative vote of tht Pieieii men they acted upon the convio cenvio convie tiou of the Sett men thai that plan, winle sanctioned by the new constitution, i.- uet legal. Upen this line the Scott iLjht will be made, aud without frittering away time upon the lower tribunals the ease will be carried te the supreme court, where, once for all, the vexed question of cumulative vetiug can ba forever laid at rest. Thei e are many precedents that support the Pierce platiei in. one instance eccming in this crty, when Kilpli Barley, in ISrfl, voted his own and II. W. Oliver's stoek, and fleeted himself director of the Pitts burgh ic Lake Eiie lailread gettirur his seat afterwaid without trouble. Otl'fi cases could be cited, but precedents will uet count in this case. In plain black and white, it is a light between the Pennsyl vania railroad, backing Scott, and Vaniler bilr, backing Pieice, and in a strusgle between these rivals all the law of the land will be brought out, both m favor of and against the cumulative clause el the constitution of the stale.
