AXTMMX1SM. Haprome Court Decision Against tbe Fenn sylvaota Ballromd Company. A dispatch from Pittsburgh dat;d October 3d, says: "The only opin ion adverse to the Pennsylvania railroad company on an important ques tion which has been filed (or years by tho supreme court of the state was rendered yesterday by Judge Tronkey, one of tho Democratic members of the court. The question at issue grew out of tbe ticket- scalping DUSiness ana was wneiuer u per son purchasing a ticket over the Pennsyl vania railroad, from New York to Phila delphia, from a ticket dealer who is not an authorized agent of the company, can maintain an action in the courts of that state for the refusal of that company to carry him between these points in return for said tickets. The court decides the sale was valid, and says : By the act of May 0, 18C8, P. L. 582, it is made the duty of every railroad com TKuiv to nrovido each agent authorized to sell tickets entitling the holder to travel upon its road with acertiflcate attested by tho corporate seal and signature of the officer whose name is signed to the ticktt, and any person not possessed of such au thority who shall barter or transferror any consideration the whole or any part of .a ticket or other cvidenco of the holder's "title to travel on auy railroad, shall be liable to be punished by a fine and im prisonment. Tho purchasing and using a ticket from a person who Las no authority to sell is not made an offense. That the plain tiff's ticket on its face entitled him to its rights as a passenger between tho points named is unquestioned. Tho only reasDn for denying him such right was that he bought from one who sold in violation of tho statuto of Pennsylvania. It is not Eaid that the vender in. New York is act ually guilty of tho statutory offense, but that the defendant, being a corporation in Pennsylvania, and the stipulated right of passage being partly in Pennsylvania, her courts will not cnfoice a contract resting upon acts which the Legislature has de clared criminal. The presumption is that the ticket was properly issurd by the com pany, and that tlio holder had the right to uso it. Such tickets are evidences of the holder's title to travel on the railroad. Prior to tbe statute iu Pcntisylvaniait was lawful for Holders to sell thero. Tlio pi op crty in them passes by delivery. Tlio act of 180 confers no right upon a railroad company to question passengers as to when or where or how they procured their tickets, or to eject them from tho cars upon suspicion that the tickets were sold to them by a person who was not an agent for the comnanv. At common law, which is deemed in ab sensn of evidence to tho contrary, the con tract uiado by tho plaintiff in New York was valid. It was executed ; no part re mained to bo performed. It vested in him tho evidence of title to a passage over the railroad. His act had no savor of illegal ity or immorality. It was a mere purchase of the obligation of a common carrier to carry the holder according to its terms. The defendant issued the obligation, re ceived the consideration and became liable for its performance at the date of issue. As transferree the plaintiff claimed per formance. This is the contract which is the basis of the cause of action. It is purposely mado to us to entitle the bona fide holder to its performance and for breach of au action iu his own name. Let it bo assured that defendant mado the contract in Pennsylvania. It is quite as reasonable to assume that tickets lor pas- sengcis coming irom jNow ior into Pennsylvania were sold in New York. But whoever the contract was mado by, it is true, as claimed by the defendant, this action is to enforce, not the contract be tween tbe ticket scalper and the plaiutiff in error, but between tho defcudaut in error and tbe plaintiff in error. Tiio sale of tbe ticket to the plaintiff in New York, was lawful. Tiiat being an executed con tract tbero is no question respecting its cnfoicemcnt. lint surely it is not an ex ception in the rule that contracts valid by the law of the place where they are made are generally valid everywhere. Then, as tho plaintiff has a valid title to tho ticket, the contract lietween himself aud the de fendant is valid. The judgmeut of the lower court is reversed.
