Lawyers in this country-seek every public position there is exoept a place in the jury box. A professional man of any sort is rarely I'ouud as a member of a petit jury. The like is. substantially true of well-known merchants, manufacturers, teachers and scholars. They will not servo on a jury unless they aro compelled. No person can bo expected 4o do good and faithful work who acts under compulsion. The bituatiou of a juryman is often burdensome and degrading. He is liabb to bo treated with little more regard than a common felon. He is taken from his homo, business or pleasure often without a moment's warning, and made lo spend a day and night in the company of persons he would never associate with voluntarily. If the case is of a criminal character, ho may be looked up during much of the time of a week or month in a clone or filthy department, and denied all the comforts of life. His business niay buffer, and his family bo in distress, but he has no remedy. He is perhaps flattered by a lawyer while the cause is being tried and regarded with suspicion as soon as the charge is made, ho is not allowed to see a newspaper for fear lie will read some comment on the trial. He is forbidden to speak to any person not on the jury lest lie be influenced by his conversation. He is kept, iu solitary confinement for fear he wi! be bribed. Ho is often conscious that bu will make enemies who will ever after ward pursue him if he brings iu a verdict of conviction. He receives no adequate remuneration for his time aud uo thanks from the public. Every juror knows that men aits rarely, if ever, accepted to try an important case ouaccouutof their Mipetior intelligence. On the other hand they know that lawyers who have a ca' of doublful merit desire man of small intelligence to try it. As a rule, the nio:e important tbo c;i;o iliu more inferior aie tho persons who com pose the jury. Every intelligent man at the present day reads tbo newspapers, and as a mi'tor of course forms an opinion iu regard to the tiuth or falsity of the statements made. This opiuiou may not bias his judgment when he hears the evidence m the case, but tho circuiu stance that he is a reading and reflect ing man often operates to disqualify him from serving on a jury. A juror is selected to try a criminal ease affecting an entire comrauuity, because he states that he has never heard of a transaction, an accouut of which has been pub lished in every newspaper in tho country, and has been the principal topic of con versation for weeks or even mouths. Such a mau every person would pronounce un suitable to sit in judgment on auy matter uf importance. His opinion would be en titled to no sort of respect. It is pieservcd as a relic of feudal times, when judges aud prosecuting attor neys where the servants of a sovereign having almost absolute power. It was then regarded as a necessary safeguard of the liberties of the people against the op pression aud tyranny of a monarch. It was styled fie "pilladium of human lib erty." Jiut it is doubtful if the necessity of such au institution longer exists iu any country where the common law pre vails, and particularly in this country, where in most of the states tho voters elect the judges and all tho officers of the uouits. It is generally conceded that it takes twice as long to try a case with a jury as without one, and that the expense of litigation is doubled in consequence. Every person who has a good case prefers to have it tried by a judge or a bench of judges. In chancery or equity cases there is no jury except iu special instance--. Still, nearly all persons aro willing to ad mit that justice is generally most fairly administered in a court of equity than iu one of common law where the issue is de termined by a jury of "twelve truo and lawful men." In Wyoming territory trial by jury is abolished as a rule, and parties to a suit cau only avail themselves of it by making a demand, and depositing money sufficient to pay the entire cost.
