"Whereas, Iu consequence of fires
breaking out in hotels, factories and ether
high buildings, many lives have been leftt
and great personal injuries suffered,
through the want of efficient means of es
cape therefrem, independently of the oidi eidi
usirj internal .stairways ; therefore,
Mixtien 1. lie il enacted, itc, That all
the following described buildings, within
this commonwealth, te wit : Every build
ing used as a seminary, college, academy,
hospital, asylum or a hotel ler the accom accem accom
ineJation of the public, cveiy storehouse,
factory, manufactory, or werl: shop of any
hind, in which employees or operatives are
usti illy employed at work in the third or
any higher .story, evciy tenement house or
building in which looms or floors are usu
ally let te ledges or families, ami every
public school building, when any of such
buildings me three or mere .stones iu
height, shall be provided with :t perma
nent rafe external means of escapa there there
feom in case of fire and it shall be the
duty of the owners or keepers of such
hotels, of the owners, superintendents or
managers of such seminaries, colleges,
academic., hospitals, asylums, .stoic
houses, lactenes, manufactories or woik weik woik
sheps, of the owners or landleids of such
tenement houses, or their agents, and of
the beaid of school direct eis of the proper

Siyne.V 2. It, shall be the duly of the

tion uith the fire marshal et the district
where such commissioners and fire mar
shal aie elected or appointed, te first ex
amine and test such lire escape, an 1 after
upon trial, said lire escape should pieve
satisfactory, then the said fire marshal, in
connection with the liie ommissieiKTS, or
a majority et them, shall grant a certifi
cate approving said lire escape: Provided
further, Tuat in distiiets where no such
lire marshal and lire eommissiencis exist,
then the scbrel directors iu each said dis
trict shall be the beard of ex immcrs, and
upon their csi tilicale, or a majority of
t-cm, of approval of said lire escape,
shall bis sullicient autheiity for the erec
tien et said lire escape in .-.aid distnet.

and every such school district, shall also
be liable iu any action for damages, in case
of death or pcisenal injury sn taincd in
consequence of lire breaking out in any
such building and of the absence of such

be maintained by any person new author
ized by law te sue in ether cases of similar
injiuies ; all persons failing te comply
with lli.i previsions of this act, shall be
