Atlce and Brown, attorneys for Edward Wclchans, took a writ of error te the supreme court for the purpose of having the order of our court, awarding a writ of mandamus re versed. This writ of error will net operate as a supersedeas, as the court has awarded a peremptory writ of mandamus, in obedience te which Mr. Welchans handed ever te Mr. Shirk all books and moneys in his hands. But if the supreme court should re vet se the court below, Mr. Wclchans will receive his costs and damages, ami have the satisfaction of knowing that his course in refuting te handover the books and money te .Mr. Shirk was proper.
