“That every person excepting Justices of the
Peace, who shall hold any office or appointment of
profit or-trust Uudcr-tho United States, or of this
Stale, or a City or -Incorporated District, whether a
commissioned officer or otherwise, who is or shall bo
employed under tho Legislative, Executive or Ju
diciary Department of this State, or of the United
States, or of any Incorporated District, and also,
that every member of Congress, ami of tbo State
Legislature, and of tbo Selector Common Council
of any City, or Commissioner of any Incorporated
District, is by law incapable of holding or exorcis
ing at the time, tho office or appointment of Judge,
Inspector or Clerk of any election of this Common
wealth, and that no Judge, Inspector or other opi
oor of such election shall. bo ologiblo to bo thou
voted for.”
And tho said Act of Assembly, entitled “An Act
relative to elections of this Commonwealth,' 1 passed
July 3, 1839; further provides, as follows, to'wit:
“That tho Inspector and Judges shall meet at
tho respective places appointed for holding tho elec
tion in tho District to which they respectively bo-
long, bo loro 1) o’clock on the morning of the 2d
Tuesday of October, nr.d each of said Inspectors
shall appoint one Clerk, who shall bo a quallified
voter of such District.
' 41 In case the person who shall have received the
second highest number of votqs for Inspector, shall
not attend oh the day of election, theq the person
who shall have received the second highest number
of votes for Judge .at the next preceding election,
shall act as Inspector in his place. And in case
the person who has received the highest numbor of
votes for Inspector ishall no.f attend, the person
elected. Judge shall appoint nn Inspector in his
peace, and in case the person elected Judge shall
not attend, then the Inspector who received the
highest number of votes shall appoint a Judge in
his place; and if any vacancy shall continue in
, the board for the space of one hour after the time
.fixed by law for the opening of the election, the
voters of the township,'ward or district for which
such officer shall have been elected, present at the
imo of election, shall elect one of thoir number to
fill tho vacancy.” ,
Particular attention is directed to the Act of As
sembly, passed tho 27tU day of February, 1830, en
titled “An Act relative to voting nt Elections in
tho counties of Adams, Dauphin* York, Lancaster,
Franklin, Cumberland, Bradford, Centre, , Green,
and Eric,” viz t
“Soc. 1. Bo it enacted by tho Senate and House
f Representatives of tho Commonwealth of Penn
sylvania in General Assembly met, and'it is hereby
enacted by tho authority of tins'same -that it shul
bo lawful for tho qualified vuters of tho counties of

berland, Bedford, Centro, Green, and Erie, from and
after tho passage of this Act, to vote for all candi

out to tho Clerks, who shall , make tho like note iu

“In all cases where the name of tho person clai
ming to, voto is not found on the list furnished by the
commissioners or assessors, or his right to vote wheth
er found thereon or not, is objected to by any quali
fied citizen, it shall bo the duty of the Inspectors to
examine such person on oath as toliis qualifications,,
and if ho claims to have resided in the State for ono
year-or more, his oath shall ho sufficient proof there
of, but lie’shall make proof by at least ono qninpo
tent witness, Who shall be a qualified elector, that ho
has resided ewithin the district for more than ton days j

riotously disturb the peace of auid.elcction, or shall
use or practice any intimidation, threats, force orVi--

shall be sentenced to pay a fine of not less than one
