NOTICE is hereby given to the Coroner, Jus
tices of tho Peace, and Constables of the said
comity of Cumberland, that theyaVo by the said
precept commanded to be then and there in their
proper persons, with their rolls, records, and in
quisitions, examinations and all other romenif'
brances, to do those things which to their offices
.appertain to bo done, and all those that are
bound by recognizances, to prosecute against
the prisoners that are or then shall bo in the Jail

WHEREAS in and by an act of the Gene
ral Assembly;'of the Commonwealth of
Pennsylvania, entitled “An act relating tolho
election's of this Commonwealth,” passed the
2d day of July, A. D. 1839, it is made the du
ty of the Sheriff of every county-within this
Commonwealth, to give public notice of the
General Elections, and in such notices to enu
merate :

bly of this Commonwealth, passed IheSdJuly,
1839, it is thus provided f “That the qualified
electors of parts of Newton and Southampton
township, in the connly : of Cumberland,, boon*
ded by the following lilies and distances, viz:
beginning ul the Adams county line, thence
along the line dividing the townships of D:ck
inson and Newton to the turnpike road, thence
along said turnpike to Centre School Hou.se,
on said turnpike, in Southampton township,
thence to a point on the Walnut Bottom Road
at Rcybuck’s, including Reybnck’s Farm,
thence in a strait line to Ihe Saw Mill of the
heirs of George Clever, thence along Kry.sher’s
inn to the Adams county Jine, thence along
the line of Adams county to Ihe.place of begin
ning. be and the same is hereby declared a new
and separate election district, the election to
be held at the public house formerly occupied
by Wm. Maxwell, in Leesburg, Southampton
township,” -
NOTICE IS HEREBY GIVEN,
That every person, except Justices of the
Peace; who shall hold any ' oif.ee or appoint
ment of profit or trust under the United Stoles,
or if this Slate, or any oily or incorporated dis
trict, whether a commissioned officer or other
wise, a subordinate officer or agent, who is or
shall be employed under the legislature, exe
ctiiivefor’iuritciary departments of litis Stale,
or nf the United States, or of any city or of
any incorporated district; slid also that every
member ol Congress and of the Slate Legisla
ture, the Select or Common Council of
any city, or commissioner nr any incorporated
district, is by law incapable of holding or ex
ercising at the-same lime, .the oflice ot.apppinl
tnenl of judge, inspector, or clerk o( any elec
tions of this Commonwealth, and that no in
spector, judge or other officer of such election
shall he elligble to be then voted for.
And the said act of Assembly, entitled an
act relating to elections of this Commonwealth,
passed July 2d, 1839, further provides as fob
lows, town:
“ That the inspector's and Judges shall
meet at the respective places appointed for
holding the' election in the district to which
they respectively belong, before 9 o’clock in
the morning of the second Tuesday of Octo
ber, and each of said inspectors shall appoint
one clerk, who shall be a qualified. voter of
such district.
"In case the person who shall have recieved
the second highest number of voles for inspec
tor shall not ajtend on the day of the eleclioh,
then ihe person who shall have recieved the
second highest number of voles for judge at
the next proceeding election shall act as inspec
tor in his place. And in case the person who
shall have received the highest number of
voles for inspector shall not attend, the person
elected judge shall appoint an inspector in hia
place ; and in case the person elected a judge
shall not attend, then the inspector who re
ceived 1 lire highest number of votes shall ap
point a judge in his place; or if any vacancy
shall continue in the board for the space of
one hour after the time fixed by law for the
opening of the election, the qualified voters of
the township ward or district for. which such
officer shall have been elected, present at the
place ofelection, shall elect one of their num
ber to fill such vacancy.
•It 'shall be the duly of the several asses
sors of each district to attend at the place of
holding every general, special or township e
lection, during the whole time said election is
liept open, for the purpose of giving informa
tion to the inspectors and judges when called
on in relation to the right of any person asses
sed by them to vole at such eleetjon, or such
other matters in relation to the assessment of
voters as the said inspectors or either of them
shall from lime to*fime require.
“No person shnll bo permitted to vole at any
election as aforesaid', Ilian a while freeman of
the age of twenty one years or more, who shall
have resided in (he Stale at least one year, and
in the election district where ho offers his vole
at least ten days ptecefedifig. such elections
and within two years paid a Stale or County
lax, which shall have been assessed at least
ten days before the election. But a citizen ol
the United Stales, who has previously heena
qualified voter of this State, and'removed there
from and returned, and who shall have resi
ded in the election district, and paid taxes
aforesaid, shall be; entitled to Vote after resi
ding in the Stale six'months ! Provided. That
the white freeman, citizens of the United Slates,
between Ihe-Sge of fwenty-oneand tweniy-lwo
years Who have resided in an election district
ten days as aforesaid, shall be entitled to vole
although they shall not have paid taxes.
No person shall bo permitted to vote whose
name is not contained in the list of taxable in
habitants furnished by the commissioners, un
less First, he produces receipt for the pay
ment within two years, of a slate or county
lax assessed agreeably te the constitution, and
give satisfactory evidence either on his oath or
affirmation, or the oath or affirmation of anoth
er that he has paid such a lax, or on failure to
produce a receipt snail make oath to the pay
ment thereof. Second, if he claim a right to
vole by being an elector between the age of
twenty-one and twenty-two years, he.shall de
pose on oath or affirmation that he has resided
in this Slate at least one year next before his
application, and make such proof of residence
in the district as required by this act and that
he does verily believe from the account given
him that he is of the age aforesaid, and such
other evidence as is required by this act,
whereupon the name of the person so admit
ted to vole shall he inserted in the alphabetical
list by the inspectors, and a note madeoppo
site thereto by. writing the word ‘tax,’if he
shall be permilled to vole by reason of having
paid tax’, or the word ‘age,’ he shall be admit
led to vote by reason of such age, shall be
called out to the clerks, who shall .make the
like voles in the lists kept by them.
* In all cases where the name of the person
claiming to vote is found on the list furnished
by the commissioners and ' assessors, or his
right to vole whether found thereon or not. is
objected to by any qualified citizen, it shall he
the duly of the inspectors to examine such
persons on.oalh as to his qualifications, and if
ho claims to have resided within the Stale for
one year or more r his oath shall be sufficient
proof thereof, but shall make proof by at lea=l
one competent witness, WhoshaTl he a qualifi
ed elector, that he has resided within the dis
trict for more than ten days next .immediately
proceeding said election, and shall also him
self swear that his bond f.de'residence, in pur
suance of his lawful calling, is within the die.
trict. and that he did not remove into said dis
tricl for the purpose of vniingilherein’.
‘Every person qualified as aforesaid, and
who shall make due proof if required, of his
residence and payment of taxes as aforesaid,
shall be admitted io vote in the township,
ward or district in which he shall reside.
‘lf any shall prevent or attempt to prevent
any officer of any-election under this act from
holding such election, or use or threaten any
violence to any such officer, or shall interrupt
or improperly interfere with him in the execu
tion of his duty,Or shall block up the window
or avenue to any window where Ihe.samemay
be holding, or shall riotously disturb the peace,
at such election, or .shall use* Or practice any
intimidating threats, force or violence, with
design to influence unduly or overawe ■ any
elector, or to prfevem him front voting or to re
strain the freedom of choice; such persons on
conviction sh ill be fined in any'' sum not ex
ceeding five hundred dollars and- be.imprison
ed lor any time not- lees than three nor more
than twelve months, and if it shall be ehown
to court, where the trjal of such offence shall
bp had, that so -offending was not a
resident of the city, ward, district or township
where the offence was committed, and not en
titled, fq vote therein, then . 'on-Conviction he
shall be sentenced tb.pay’ a fine of hot less.
Ilian one'hundred nor more than one thousand
dollars, and be inprisoned not less than six
month-nor more than two years. .
If any person or persons shall make any bet
or wager upon the result of any election with-'
in.the Commonwealth, pr shall offer to make
any such bet or wager, either by verbal pro
clamalion thereof, or by any written or prin
ted -advertisement challenge 01 invite any per
son to make such bet or wager, upon convic
tion thereof he or they shall forfeit and pay
three times the amount so bet or to he bet.
‘lf any person not by law -qualified, shall
Iraudulenlly vole at any election in this Com
monwealth, or being otherwise qualified shall
vole mil of his proper district, or if any person
knowing the want of such', qualifications, shall
aid or procure such person to vote, the person
offending shall, on conviction, be fined *in any
sum not exceeding two hundred dpllsrs, and
be imprisoned for any term* not exceeding
three months. - ■ -
‘lf any person shall vole at more than one
election district, or otherwise fraudulently vole
more than once on the same day. or shall
frapdlently fold or deliver to the inspector two
tickets together, with the intent illegally to
vole, or shall procure anotherc so to do, he or
they offending, shall on convition be fined in
any sum not less than fifty nor more than five
hundred dollars, and be imprisoned for any
term hot less than three nor more- than
twelvemonths, .
‘lf any person not qualified to Vole in this
Commonwealth, agreeably ,to law, (except
the sons of qualified citizens) shajr appear at
any place of election for the purpose of issuing
tickets or of influencing the citizens qualified
to vole, he shall on conviction forfeit and pay
any sum not exceeding one hundred dollars
for every such offence, and be imprisoned lor
any term not exeecding three months."
Agreeably to the provisions of the sixty
first section of said act, every General and
Special Election shall bo. opened between the
hours of. eight and ten in the forenoon, and
shall continue wilhout inlei-ruption nr adjourn
ment until seven o’clock in the evening, when
the polls shall be closed.
And'the Judges'of the respective districts
aforesaid, are by the said act required to meet
at the Court House, in the borough of Car
lisle on the third day after the said day of elec
tion, being Friday the 16th Jay of October
then and there to perform the things required
of them by law.
The return judges of the Representative dis
trict, will meet at Carlisle, at the time fixed by
law.

PROCEEDINGS in portion in the estate of
John Garrett, late of Upper Allen township,
deceased.
The petition of Andrew Garrett, to tlio Or
phans’ Court of Cumberland county, respectful
ly represents, that John Garrett, late ol Upper
Allen township, county aforesaid, died intestate
leaving neither wife nor child, never having
been married, but leaving a mother, brothers,
and sisters surviving him, to wit: Catharine
Garrett his mother, and Frederick Garrett a
brother, Ann Garrett a sister, Susan Miller mar
ried to Daniel Miller, a sister, Andrew Garrett,
your petitioner, a brother, and Benjamin Gar.
rett, a minor son of intestates brother Jacob
Garrett, who has Jacob Mununa as his guardian,
and Andrew Carver a son of Elisabeth Garvor;
who was a sister, of intestates. The said parties
being the heirs and legal representatives of
