Counsel for Dr. Swallow said to the court that the supersedeas would lie almost necessary to secure justice for Dr. Swallow, as, if the proceedings were not stayed. Dr. Swallow would lie forced to pay the fine, and if the court should reverse tiri- decision of the lower L-court he would have no way nnder ex isting acts of assembly to get restitu tion. It was also alleged that the charge against Dr. Swallow was not an indiotable offense. Judge Race asked counsel to present to the court in writ ing the points raised in the application for the supersedeas. The state taken as a whole is against the strike for financial reasons, and all who have struck have been brought out under tho pressure of the organizers and agitators from else where. Generally they have been shamed into striking ami their minds change when the agitators move on to other sections. They say they will not return to work until their demands are conceded. Miners Near Wheeling Persuaded to Throw Down Their Tools. Wheeling, July 21. The 100 miners employed in the works of the Glendale Coal company, eight miles below Wheeling, have struck. A few days ago the t;o-cent rate was conceded to the men with the understanding that they would not strike. Since then, however, the officials of the Panhandle district union have been at work among them.
