On Wednesday of last week the Doard of Public Ruildiiigs and Grounds in Harris burg selected a design for the Ch"rrvtree monument, for which an appropriation of fl.r.oo was made by the last legislature. The monument will bo of granite, thirty three feet high and w ill lie erected in tin ned of the river at the place where Cam bria, Clearfield and Indiana counties once intersected, but now by an act of the legis lature in the borough of Cherry tree and in Indiana vonnty. The spot w as long know n as "l anoe Place," and in one of William Penn's deals with the Indians, marked the boon Jary of his purchase, and a line that ran from the Chen ytree to a point on the Allegheny river at or near Klttanning w as know n as the "Purchase Line." James Weakland w as born In Cambria county. Pa., in the year 1323, and on De cember 29, i46. at the ags of eighteen years, he volunteered and was enroll at Ebensburg as a member of the Cambria Guards as a private soldier in Company D, 2nd Regiment, Volunteers, to serve his country during the war then waged by the Utiited States against Mexico. He served gallantly throughout the entire war, and was present with his organization when the victorious Americans took by storm the position of Molino del Key on Septem ber 8, lf-47, and the lofty fortified hill of Chepultepecon the 13'.hof the same mouth. He also took part iu the famous charge on September it, lf47, when General Scott en tered the Mexican capital in triumph, and ordered that the stars and stripes be dis played on the national palace. He re mained with his organization until the war was ended, and theu returned with Lis organization to the state of Pennsyl vania, and on July 14. 13fS, he was given an honorable discharge from the service. He then proceeded to his home In Cambria county, and on the 2nd day of April, 13a0, w as married to one Miss Elizabeth Luther. The union was an exceedingly happy one, and out of the same there were born three children. Aliout the year 13.VJ, however. the husband suddenly disappeared from the neighborhood, and although his wife and children and other relatives have in many ways for the past T.hirty-cight years sought to gain some information of him, yet not the slightest information have they been able to secure. The wife has therefore for many years mourned him as dead. On April 0, l$t2,Mrs. Weakland, through her attorneys, tiled an application for pen sion under act of congress approved Janu ary 20. 1S87, alleging therein her belief that her husband is dead, and hence she is a widow. In support of her application for pension, she presented the evidence of a large number of her neighbors and friends. There was also prescntcdas evidence in her case, a eel li lied copy' of the letters of ad- miiiisirataoti that were granted on Sep- temlM-r 12, 1S'.2, over the estate of her hus band, by the Probate Court of Cambria county, which recited that from the evi dence presented to said court, it w as satisfied that the said soldier w as dead. judicially. The authorities of the pension bureau then placed the case iu the hands of one of its -pecial examiners for investigation into its merits; and although the special ex aminer was unable to obtain any proof showing or even tending to show that the soldier was still alive, the claim was re jeeled on December 7, lS'.O, on the ground that the applicant was unable, "although aided by a special examination of the case, to prod uce proof showing, as a matter of fact, ihe death of the soMier." From this action her attorney entered an appeal to the Secretary of the Interior. On January 2.", IS'.it. the case came up for consideration before Hon. John M. Reynolds, Assistant Secretary of the Interior, who, after re viewing all the facts in the case, reached the following conclusion: "I am of theopinion that w here there are no rebutting or superior counter-presump tions, seveu years' uxexplained continuous absence from his family with whom his do mestic relations were harmonious, raises such a presumption of death as to entitle his widow to a pension under the act of January 29, 1SS7. the other requirements of said act being shown. "i he action of your bureau appealed from is reversed, and you will proceed to adjudicate the case in conformity w ith the foregoing opinion."
