that the chief burgess of all boroughs in
corporated under tin general borough law

against Frank Stern wore then called, hut
the plaintiff was not ready to proceed and

F. D. Sanpp vs. Alfred Jordan, a feigned
issue, was next taken up ami a jury em
paneled, but was afterwards settled.
The case of P. F. Shatlcrvs.A. F. Stutz
man and Kachael Hays was a feigned is
sue to decide tne question of ownership Of
certain personal property which had been
levied on by the sheriff, at sui t of St u tz
inan and Mrs. Ilayey, as belonging to
Peter Khodcs, dairyman, who livis on
Shaffer's farm in East Taylor township.
Shaffer claimed that be bad bought the
property in dispute on December ls;c'.
Jury decided in lavor of the plaintiff.
The case of Joseph Sloan vs. Mrs. Wil
liam lielestine in w hich plaintiff claimed
money due him for building a foundation
for a bouse, was taken up. but the plaintiff
not appearing, a verdict w as given to de
fendant. Charles Zimmerman vs. (Jeorgo W.
I tibert, of Johnstown, was on trial when
court adjourned at noon. Mr. Zimmerman
went on the stand and said that in Febru
ary, be bargained with Mr. DiU-rt
for a lot in the triangular strip at the
Junction of Morris and Somerset street,
agreeing to pay M.ii for it, ami give f no
cash tiow n; that at the time of the bar
gain be was led to believe t.to lot was on
the alley; that he supsoiiueiitly discovered
it was not; that he offered Mr. I tibert the
additional .'.;i for a deed for the alloy
lot, which Mr. Dirhcri refused. Mr. Di
rbert took the stand in contradiction, ami
Slid the lot he hail sold was not the Olio
Mr. Zimmerman had in bis mind. The
jury rendered alverdiet for the defend
ant. In the case of S. Klincoitllingcr vs.
Mrs. Hose McGough, a suit to recover
MT.s.s for liquors s,,ld to defendant, a
verdict was rendered for the plaintiff.
In the case of Not ley fc Hal ter vs.
John McMullen fc Curt Calderwood, was
an act ion to recover ?is.'(ti on a Uh,k a -count.
The defence was that McMullen
had aid the account. The jury foil ml a
verdict for the plaintiff against Cord
CalJerwod.
The cases of F. II. and II. II. lien ford vs.
E. A. Zimmerman to reeover $0."
for the list, of a team and damages for
breaking. The defendant's storv was that
he hired a team from the plaintiffs to go to
Stoyestown; that on the journey an ac
cident occurred and the vehicle was Irok
en; that w bile gow ingdown a bill the strap
of the yoke broke and let the tongue drop,
the horses running off. upsetting the car
riage, anil throwing him-elf ami family lu
the ground. Mr. Zimmerman claims that
the strap must have been broken, or else it
was rotten, ami that the aceideut was not
caused by any negligence on bis part.
The jury returned a verdict for the de
fendant. Court adjourned at noon on Wednesday.
According to an act of Assembly of 1S7
there is no established fence. Every far
mer is requi red to fen ?e in his ow n stock

The law docs not prescribe the style of a
fence to bo built along tloj public road and
if cattle escape from their enclosures and
trespass on fields along public roads not
enclosed by fences the owner of the cattle
is responsible for any damage they aiay
do. The law may be briefly summed up
this way: Fence In your own stock and let
your iieighlxir do likewise or pay tht ien
alty. You are not required to maintain a
fence for any other purpose than to en
close stock.

the building, and, owins to its peculiar
construction, a draft was continually pass
ing through the place, which caused the
flames to spread very rapidly, enveloping
the entire structure. When the tire was
first discovered a telephone message was
sent to the ower house to turn the cur
rent on. in older to run out the tweut
tive cars that were in the sheds. This was
immediately done, but so rapid was the
progress of the flames that bv the time the
current was on the wires had been burned
through, and the watchmen and others
w bo hat arrived at the scene of the fire
were unable to save but three cars and
ahorse lx-longing to the superintendent,
w hich w as stabled in the sheds.
Tht iiiotormon employed on the road all
suffer loss by the fire. Each of them bad
considerable heavy clothing that was
worn while on duty and from ?to to (1 in

in the office. Their clolhing was consumed
ami the money in silver, nickels, and pen
nies, of which a great quantity was found
in the ruins this morning, was blackened.

A Fatal Arrldrat-
John Dillinser, a carpenter residing at
Lilly, was struck by Johnstown accommo
dation ami instantly killed on Monday.
Tin fatilitv occurred at Lear's crossing,
near Portage. Itolliugi-r was walking on
tne south track and as a freight approach
el, he stepetl to the nol th track to get
out of tin way of it and to go to his work
at Cassandra. The noise of the coming
freight deadened the sound of the ap
proaching pas-cnger train, and before the
unfortunate man knew be was in danger,
the engine struck him. killing him in
stantly. One of bis legs w as complete
ly cut off while the other was badly crush
ed. His head was iiattered to a jelly. He
bad a kit of carpenter's tools w ith him and
was on his way to work. His l-ody was
picked up by the accommodation trainmen
ami taken to Portage, from whence it was
returned to Lilly ami prepared for burial.
The deceased was agetl about 4." years and
was a widower.

church this place. The lecture is gorge
ously illustrated, manv of the illustra
tions being of exceptional magni licence,
