The trial of George Hufnagle w hich was before the court on Thursday of last week when we went to press, ended on Friday afternoon by a verdict of acquittal. The evidence in the case tended to show that on the Tth day of Octoler last, Willliam White and Uert Eger were in Nicktown and were starting out in a cart to look for Eger's pocket-ltook which had been lost, when Thomas liurke asked them to take him along. They went as far as Hufna gle's, w here they stopped. Hufnagle is an old German, about 50 years of ago, and keeps a little grocery at a cross roads, about two mil-s south of Nicktown. While there Uurke pulled out a pint bottle of whiskey and wanted a glass from the old man. Hufnagle handed him a glass when Itvrku demanded another, and grabbing the one, hauled back and said: "I wouldn't stop much and knock your d d old brains out." He was quieted by White and Eger, when he called for oysters and crackers and afterwards refus ed to pay for them, and tiehaved In a bad and disorderly manner. When Whito and Eger were about leaving, without IJurke, Hufnagle requested them to take Rurko away w lth them. They did so, taking him atiout three-quarters of a mile away, where they left him on the road. Some time in the afternoon, Purke returned to Hufna gle's and was very disorderly. Hufnagle had repeatedly requested him to go out and he refused to do so. Hufnagle finally got his revolver and threatened to snoot him j If he did not go. Ilurke still persisted in ; remaining when Hufnagle snapped the re- j volver but it failed to go off. He snapped it agaiu and it went off, tho bullet striking Kurko In tho forehead, from the effects of which he died at the home of his father in Strongstown on the 20th day of October. The jury was evidently of the opinion that Kurko himself was to blame for the shooting, it having also appeared in the 1 evidence that he had frequently been at I Hufnaslc's and was quarrelsome and disorderly wheu there. Our report of the case closed last week w ith the statement that Ira ISlooni, of Wil more, one of the jurors in the case, was taken sick on Wednesday night, and on the meeting of the court on Thursday morning, was unable to Iw present iu court. T'.ie Hufnagle caso was taken up in tho afternoon and occupied the time of the court until Friday at noon, wheu the case went to the jury. Ou the meeting of the court ou Friday afternoon Mr. liloom, the sick Juror, was able to be out and the jury was brought iuto court, wheu the case was terminated lu an unexpected manner. The prisoner, with leave of court, withdrew his plea of not guilty and substituted the pica of guilty, leaving the degree to le fixed by the court. Judge Furst then filed a decis ion fixing the crime as of murder iu the setoiid ti-gree. w iicn tne prisoner was re tjie j mand-d to jail until the meetiugof Court on t rmay evening. At 7 o.cloek the court I met and the prisoner brought in for sen j lence. On being asked bv the court if Im ; had anything to say. he "replied in a few broken word.saking foi mercy on account of I his children. His attorneys also made ap i jx-als in his behalf and presented a jM tition j signed by ten of the jurors, appealing to tho court for mercy.
