The plaintiff was insured in the concern, and one night during the summer of lf77 his barn and contents were destroyed by fire. This action was brought to recover the insurance money. In the testimony for the defense it was develop ed that some time in the year 17. the barn of plaintiff had become badly infested with fleas, and in order to get rid of the pests he ' had conceived and carried into execution ' the novel idea of setting fire to the manure I heap contiguous to the barn and reducing it j to ashes ! Some time during the same night I the barn caught fire and burned down. Per contra, Margret swore that she always attended to her house hold duties to the best of ber ability, cooking whatthere was to cook, and at the proper time : that she never attempted to poison any person, but that the shoe was on the other foot that her husband had tried to poison lirr; that her necessities compelled her to take a lMirder and to open a shop to mend shoes in, which accounted for the presence of men in her house sometimes; that she used no profane language, and that, to cut it short, she was a perfect paragon of a woman so to speak.
