He was going westward with bis train about midnight, and when near the signal tower at South Fork fell be neath the wheels. One foot was torn off, and the leg from the ankle to the hip was horribly mangled. He was removed to East Conemaugh and medical aid summoned, but earthly skill was of no avail to save. At the June term of Venango connty court, 18ft. a writ of replevin was issned by the Syracuse Pit Hole Oil company against otie Carotherg. : At the October term, ISil", judgment was rendered for plaint ifl's, with verdict on judgment. It is a rule in law that unless a ; motion for a new trial be made nt the term ' at which judement was rendered, the Court has no authority to grant a rehearing, ami the finding would be conclusive unless re versed by the Supreme Court. On th HS'li of March, 1)WR, two terms of court having in the meantime elapsed, the defendant took a rule to slmw cans; why a new trial thouki not be granted. The rule was argued before President Judge Trunkey ami Associate Judge McCormick, in the absence of the other occupant of Ihe liench.
