Johnstown District Coiuit Judg ment of Ouster A'jainst Judge Potts. Fol lowing js the full text of the judgment of ouster pronounced last Monday by the Su preme Court, through Justice Agnew, in the case of the Commonwealth ex rel vs. Hon. James Potts. President Uistnct Court of Cambria county ; It is true the case is not ruled absolute by that of the Commonwealth vs. George T. Swank, decided at Harrisburg in 1872, the defendaut now not being a party, yet the ground on which his claim rests to the office of President Judge of the District Court of Cambria county was fully considered. The opiuion then expressed was rendered neces sary to prevent litigation aud uncertaint y iu the administration of justice withiuthe Dis trict, and cannot be treated as a mere obiter di'-tum, or a thing said on the way. It is unnecessary to repeat all we said of the unauthorized character of the Court, as organised by the act of April 13, 1S69, P. Li. fi94. The pith of the opiuion in this resect is contained iu the following scntcucos: "It is evident that when, by the proviso, the Legislature directed the Court should bo or ganized by the Presideut and Associated Judges of the Courts of Cambria county, it excluded all others from the office. The proviso, it is true, is not according to the Constitution, ahd the Judges of the Courts of Cambria comity canuot till the offices, but its effect was to qualify the enactment, so that no other could till it without further legislation; no substitute having been pn vided the Court, not !einn one of those created by the Constitution itself, has noth ing to stand upon except the law which created it, and this being defective iu its vital points, it is left without any legal or ganization." It is now contended that the Legislature having created a Court; and the proviso in the seventh, section, making the Judges of Cambria county its Judges, lieing uncon stitutional and void, the Court remained in existence, and its President and associates must be chosen under the Constitution and laws of the Commonwealth. This, however, is simply a denial of what we had said, to wit: that the effect of the proviso was to qualify the section so that no other than the .) udge of Cambria county could hll the office. The question is one of interpretation merely, and we adhere to our . former opinion, not withstang the able aud earnest argument of the counsel of Mr. Potts. The whole law evinces that it was not the intention of the Legislature to create a new Court, wholly independent of the judicial organization al ready existing iu the county of Cambria. The purpose, though a very mistaken oue, Was to add to the existing judicial organiza tion another for a portion of the county - com posed of the same J udges and officers, which should occhpy a subordinate position. The f.rst six sections establish the Court, define its powers, but now here fix the num ber of J udges. declare their grade or provide for an election at any time or place. The seventh Is tho first section to declare the or ganization of tho Court and determine who and how many Judges there shall be, aud it declares they shall be tho Presideut and As-six.-iates of the Courts of Cambria county. The fact that this declaration is put iu the form of a proviso is not any less declaring of the legislative intent, and intent ia the pro visions making the Proihonotary of the Common Pleas the Clerk of the District Court, and requiring it t be attended by the District Attorney ami Sheriff. Additional evidence of the parasitical tye of the Court is that the provision of its judgment shall not be liens on real estate until transferred to the Commou Pleas that no real estate shall be sold under its executors, und that but one geueral lien aud extension docket shall lie kept as provided by law, to-wit: that of the Common l'leas. All thtse pro visions are heightened in their effect by the entire absence of any other provision for election by organization or otherwise. The respondent Pets forth an election an Judge of the District Court at the general election of the year 1871 as his title to the office. Put. it is very evident there was no authority for this, if our interpretation of the ;u't be true that tiie proviso so qualified the enactment that none but the J udges pro vided iu it can hold the offices. Though the proviso may not be effectuated because of its unconstitutionality, it cannot lie stricken out in giving the interpretation to the sec tion. The section sjieaks as authority in its purpose, and not in part which may be sev ered without violence to the legislative pur pose, w hereas here the parts are so depend ant that one cannot take effect without the other, so as to carry out the legislative in tent. We cannot legislate by way of substi tution. The answer of the .respondent is objec tionable as being argumentative to a degree. Hut the facts set forth in it are covered by the demurrer of the Commonwealth, ami can be readily separated from the argu mentative portions. As these facts do not constitute a sufficient titl to the office of President Judge of the District Court of Cambria county, we must give judgment against the defendant. Aud now to-wit, October 20, 1S73, this case having been duly heard and considered by the Court, it is ordered that judgment of ouster lie rendered for the Commonwealth, and against the defendant, and it is hereby ordered and adjudged that James Potts, the defendant, unlawfully holds and exercises the office of President Judge of the District Court of Cambria county, und he is hereby excluded and ousted therefrom. The trees, which are usually brightest in color at this season, are now at the full perfection of their autumnal hues. Day after day the skies are so bril liantly clear that far objects seem near, and the flood of sunlight, tempered now by the angle at which we get it, lights up the wooded hillsides and the painted mountains with a glory which sometimes alulost see iris to belong to a better thau any earthly clime. The moruingsare crisp, sparkling, inspiring, full of October's frosty and invigorating breath, and brilliant with a wealth of varied color surpassing anything known to the summer; the noons fairly glow with the combined effect of the still warm sun and the variety of colors endlessly outspread; the afternoons are full of the bright but quiet lieauty peculiar to the afternoons of the first half of October. These afternoons develop the most jerfect illustrations of the peculiar spirit of the season, steeped as they are in the very atmosphere of what may be -jailed the autumnal sentiment; still, clear, soft and sunny, but pulsing all through with an interior heat beat of half sadness an im palpable undertone of pensi veness, which breathes of life and warmth and color "pass ing away." We say stories of this kind have been told time aud again, but whether triie or false it is notour purpose now to inquire. "NVe merely wish to say that, if true, Mr. M. L.Browu, of this place, agent for the renowned and unsur passable Singer Sewing Machine, is not the man who did the swindling, lie has a ma chiue that cau and does recommend itself, and he has come among us to make an hon est living in an honest way, and would not resort to any disreputable dodges if a for tune could be made in the operation.
