An answer was filed this morning in U. S. Circuit Court in the case of the Cameron Lumber Company of Camer on, Pa., against J. W. Spangenberg of Ohio and John R. Droney of this dis trict. A bill of complaint was filed j some time ago alleging that on May 10, | 1902, the defendants entered into a con- I tract with E.V.Dunlevie to furnish him 1 6,000,000 feet of lumber at st> a thous- I and feet. Oil May 15, 1903, Mr. Dunle- j vie assigned his contract to the plaintiff lumber company, which now claims j that no part of the lumber has been 1 delivered and brings suit to recover { $31,800 damages. The defendants Bay they were acting ' only as trustees for the creditors of j W. D. Johnson, and are not liable in dividually. They claim that when the contract of sale was made Mr. Dun levie agreed to trim the rough log tim bers, but failed to do so. It is also claimed that the amount of lumber contracted for was only 473,000 feet.— Buffalo News, 21st. The above suit was commenced in the courts of this county last February but was discon tinued.
