Y., April 2!).-The spe cial frauchlse tax law has been de clared constitutional by the court of appeals by a unanimous vote. Judge Vanu wrote the opinion. Tho court re verses the decision of the nppulhtte division. This decision Is on the appeal of At torney (Jeneral Ounneen from the de cision of tin appellate division of the supreme court of the third department, banded down on Jan. 'Ji lasl, declaring the special franchise tax law to be In valid. The court of appeals sustains the constitutionality of the law as a whole. The appellate division decided that the law was unconstitutional In that It gave the state tax commission Instead of the local assessors authority to as sess the local franchises. The court of appeals holds In brief that tho legislature In creating n new system of taxation, embracing a new kind of property never taxed before, had the right to Intrust the power of making the assessment to state otll- cers nnd that tangible property, such os rails nnd poles, which had been for merly taxed by local assessors, was merely Incidental to the special fran chises and hence that there was no In fringement upon local slf govern ment. In his opinion Judge Vann reviews the enactment of the special franchise tax law and the litigation which has followed In the efforts of the corpora tions to declare this law unconstitu tional or unworkable. He also reviews the various constitutions of the stato regarding the home rule principle. This decision means thnt the corpora tions will have to pay this tax for four years back, and It has been estimated that It would raise anywhere from $3,- 000,00(1 to $4,500,000 annunlly, so that in back taxes anywhere from $12,000, lioO to $18,000,000 Is duo from the cor porations. None of tho revenue from the franchise tax go to the stato treas ury, but all go to the localities In which they are raised. Washington, April 27, 1903 That the presidential boom of Senator Fairbanks of Indiana is causing grave concern to the Presi dent and his supporters has been un mistakably shown during the past week, and Civil Service Commissioner. Foulke is going to throw himselt into the breach, resign from his present position and go out to Indiana to try and win the Hoosier support for Mr. Roosevelt. It is well known that as long ago as the republican convention which nominated Mr. Roosevelt there was a pact made between Senators Hanna and Fairbanks binding the latter to support the former in case he desired to succeed Mr. McKin ley and Mr. Hanna to support Mr. Fairbanks in the event that the form er did not wish to enter the nee. Senator Hanna now appears to be lievc that the best chances of republican success lie in the nomina tion of Mr. Roosevelt, nevertheless he is bound to support the Indiana statesman if the latter calls upon him to redeem his promise and Mr. Hanna is not the man to go back on a politi cal promise. A report has reached Washington to the effect that Dr. W. Godfrey Hunter, ex-Minister to Guatemala and a prominent republican leader of Kentucky, has become an active Fair banks manager in that state and is working to secure a solid delegation pledged to the Indiana Senator in the next convention. Some prominent Kentucky republicans say that Dr Hunter will not be able to "deliver the goods " but the mere fact that he has been authorized to make the at tempt is most significant. North Carolina republicans would, it is staled on excellent authority, gladly vote for Mr. Fairbanks in preference to Mr. Roosevelt and practically all of the southern states nil follow the lead of Senator Hanna who is the idol of the republican party in the South. Meanwhile the split between Senator Piatt and Governor Odell in New York is an occasion of serious anxietv and it is held, not without reason, that the President will be un able to carry his own state. In fact Mr. Lou Payn, a long acknowledged republican oracle in New York state says the democrats will carry th state by 100,000 votes. Notwithstanding Postmaster Gen eral Payne's statement that no Con gressional influence is being brought to bear to hush the post-office scandal and save the real rascals from expo sure, a surprising number of Congress men are calling daily at the Depart ment and are spending hours with the Postmaster General. Senators Aldrich, Stewart, Spooner and a num ber of others, usually absent from Washington at this time of the year, have had long conferences with Mr. Tayne and Representative Babcock has come to Washington to stay a month and has already ha 1 his first interview with the Postmaster Gen eral. First Assistant Postmaster Gen eral Wynne and Fourth Assistant Postmaster General Bristow continue to receive charges of malfeasance and dishonesty although Mr. Payne tells the newspaper correspondents each night that he knows of no new de velopments. One charge, mentioned in these letters a week ago, has proven so grave a violation of the law that the Postmaster General, without waiting for further investigation, has been compelled to take action. The "bookkeeper-Machinists" who travel led about the country on pretense of repairing the cancelling machines in use in large post-offices, have been ordered to return to their desks in the various postoffices to which they te charged. A $1,000 clcik, a negro, wh i was charged to the city post- office in Washington, but who had een detailed to act a his special messenger by Superintendent Beavers, as already been required to return lo the woik for which he was employ The decision ot the Postmaster General requiring postmasters from whose offices Iree rural dslivety routes start, to post the names of all residents along those routes in the local postofficts will probably occasion serious trouble for the Administration. It has already been pointed out to the Postmaster General that this custom is the occasion of serious hardship to local merchants and newspapers. These lists of names are used by the great mail order houses and the big dallies to solicit business and sub scribers to the detriment of the local businessmen and the latter have pro tested, but in vain Meanwhile the nail order houses are reaping a har vest and the daily newspapers are adding materially to their subscrip tion lists. Accidents in the navy continue to multiply and Secretary Moody, while esisting the influence exerted to pro cure a general investigation, appears to be entirely helpless in the premises.
