The Blocmsburg Water Company is a cor- poritlon incorporated and chartered under the rovisions of the Act of the General Assemblr proved the 29th of April, 1874. The con- tany is authorized and empowered by them- lv. s, their agents, engineers and workmen, nd with their tools, cart', wagons, hearts of raught or burden to enter upon such lands nd enclosures, street', lanes and alleys, roads, highways and bridges as may be necessary to iccupy or to obtain materials for Ihe construc tion of their works, and lo occupy, ditch nnd ay pipes through the same, and the same from ime to time to repair, doing as tutu dam age to said streets, lanes, alleys and highways and impairing the free use thereof as little as possible, and subject to such regulations as the- councils f tho borough, town, cily or district may adopt regard lo grades or for the protection and convenivneo ol public travel over the same. The right of Ihe company to enter upon the treets, lanes and alleys in question to lay pes is not and cannot bo disputed, and it ccms to me that the only question to be deter- ined is whether in doing so, they have done are doing as little damage lo and impairing e free nsu of the same as little as possible, Owing lo the press of official business I have not Ihe time, nor do I deem it necessary to writea lengthy opinion. After carefully con- lering all the evidence on both sides I have come ti the conclusion that it has not been clearly shown that the company is or has been doing any unnecessary damage to the streets, lanes or alleys but that they have im- aired the freo use thereof as little m possible, nor have they altered or changed the grades as adopted by tho (own councils. Doubtless some neonvenience has occurred and will necessari ly continue to occur during tho construction of the company's works. In tho construction of II public improvements such matters must gen rally be submitted to for a while- The princi pal complaint Is, thatthere are mounds of earth ft over the pipes, much higher lhan the sur face of the streets, but, the evidence, if believ ed, shows that in a short time this material will naturally pack and the mounds disappear, nd that it would bo imprudent lo take it away without giving it time to settle or pack. As I stated, I am of opinion that the compa ny and the other defendants nro doing as little amage as possible and are impairing the free use of the streets as little as possible and have not interfered with the grades of Iho same an 1 cannot see any reason why an injunction should bo allowed to continue. If, at any time, it can be mado clearly to appear that the com pany is not doing the work in accordance with the Act of Assembly another application can be made for n special injunction which will in that case be granted.
