So for as relates to the merits of the firs! lection, the main facts in the case appear U be these: The Bedford and Hoilidayaburi Turnpike Road Company needed a bridg over the Raystown Branch ot the Juniau and in !?:*>. contracted with one John Ar noid to build it. Arnold employed Jamei Clark to erect the bridge, by a written con tract la:-- ! in Sept. iSipj. uu.ler which Cia.o bnilt the bridge. The company subsequent!; became insolvent, and forfeited it# charter It is now ailedged that Clark was never pair for erecting the bridge, and this bill, nearly thirty years afterwards, proposes t authorial him "to enforce the collection of bis clain against the County Commissioners of Bedfor' county. However good this claim may have beet ! at one time, against the parties to the con I tract, its great age does not recommend it U i favor.
