the
The following concise and convincing loiter
of the Postmaster-lteucral ia made by the Sen.tto
Poet Office Committee a part of their report ia
the eae of Cborpeniilnif:
Post orricB Departmknt, Washington, P. c,
Feb. 4, 1B7L Hon. Alexander Kainaer, t'liairmm
or the Pout Ofllne Committee of the Senste My
lear Sir: The Senate having referred to your com
mittee the House resoluU-.u for the repeal of tun
resolution of Congress approved July 10, 1970, I
have the honor to luvlte at tne haud of your com
mittee a mest searching investigation Into all the
proceedings connected with the claims of Oaorjre
i'borpenntiig, and to reqnHt thitt no report may tie
made until yon can confidently speak as to my good
or bad faith in respect thereof.
In Justification of myself I desire to make a brief
statement.
onthesvdof September, 1889, Chorpenning pre
en ted to me, as Postruaster-Ueoerat, a potltioo,
wherein he asked for the reversal of a decision ma le
fcy Postmaster-General Brown, and for an a'lwtri-e
of an additional sum of money In the way of extra
compensation uuder the tlrst section of the act of
March 8, 1857. Alter hearing the arguraeut of
counsel I gave a written decision on October ia,
I860, adverse to Chorpenning. and dismissal hU
petition on tie same ground as that assumed bv
my predecessors, Messrs Molt, Blair, and Randall
namely, that the case had already been decided
by Postmaster-General Brown, and should n t
be disturbed without further legislation. Tnis I de
clared to be a final dixposttlou or the case upon the
law as it then stood, and supposed that I should
never sgnln during mv term i f office be called upon
toconsider It. Hut by a J.lot resolution or Congress
spprovec July 15, 1S70, the FOHtmaster-U-ener.il w
directed to investtgate and adjust not only the
claims of Chorpenning, nnder the tlrst section of the
set of 18BT, on the basis of compensation allowed by
laid act for the regular service, but a'so a certmu
other calm growli.g out of the curtailment aad an
rnlraent of his contract on route li.s.ii, m t.tv
basis of his agreement with the Postmasrcr-Qeneral
for that service. Tills art was mandatory, and en
joined upon me the laborious and disagreeable t usic
Of investigating and adjusting certain snecUIed
claims in n pres- rlbed manner, at a tlxe 1 com pens,
tlon, and according to "the ailldavits mid proofs on
file in the House of Representatives" in 18M. I was
insde a mere accounting oillcer, and was chareed
with the adjustment of Chorpeniiing's claims, uudr
the act or isr.T, according to uualUf able aud arbl
tinry rules.
ys soon ss able, 1 reluctantly proceeded to dis
charge my duty, to the best of my ability. The re
sult of niy labors I present to you in the form of a
report, it fully details the manner of ray decision
and the reasons therefor.
Having given to the subject the best aVlitv and
Study I could command, 1 sent for Mr. J. N. 1) vls,
one of the most, upright, laborious an I competent
of my subordinates, aud submitted to him my report
for bis carol ul revision. Me returned It at thu close
of the day with but one objection. His point was,
that I had erred in allowing for extra services prior
to the 1st or July, 18&3, at the rate of $;!(). uim per
annum, rather than at the old contract pri;e of
1 14,000 peranuum, 1 answered that I ha t alrealy
carefully considered that point aud was obliged ti
overrule his objection. Trils 1 felt eonstra'nei to do
in obedience to the very words of the law. If, how
ever, I hud adopted Mr. luvl' suggestion, it, would
have mane a difference of nbont four or live thou
sand dollars in the amount of the a ward.
1 concluded my official connection with ttio cse
by formally filing my report in the depintnent on
the 93d of December last, whe-e it hs ever hince re
mained, subject to Inspection and exmiua'l in.
It was not until the T'h day or .T iuiiary that a c ipy
of it was transmuted to the HI t.ii Auditor. 1 never
signed any warrant, draft, order, or other authority
for its payment., or directed or requested any other
oillcer to do so. On the contrary, I sent forjudge
Martin, the Sixth Auditor, and his chief clerk, Mr.
McOrew, and after telling them of the magrulutde
and character of the cl'liu cautioned tliutn to
make a thorough examination into the wholo sn
ject before taking any sreps for its pivrasnt. I ob
jected to its payment out of the regular appropria
tions for the postal service, because no estimate hid
been made for it nudpr any of the heads thereof,
and insisted that 11 paid at all it sh iul'1 be pall out
of the general treasury. There was no concealment
or attempt at conceal ment, no effort to lias'en its
payment, or to cover up Its magnitude. So far
from being surprised at the publicity which has
been given to my report, I can poaltlvely say
It Is precisely what I expected. In the
belief that the case would be tnoroughly can
vassed after it left my hands, I took the time, which
I could 111 spare from my ether duties, to prepare
the above-mentioned report. That report was made
according to my best. Ju Igment, without fear, favor,
or affection, and under the operation of the las
which fettered my action, I believe it to be correct
If I were roauired to execute the same laws ag tin
to-morrow, upon the same "affidavit and priofs,"
I could make no change In the ard I have already
made.
It never occurred, to mo that I conld escape the
performance of the duty so clearly enjoined by the
law of 1870, by referring the law Itself back to Con
gress. Postmaster-General Brown, In his report of
1867, had called the attnt.,on of Congress to the
doubts that beset htm In his efforts to execute the
law of the same year, and numerous efforts have
Since been made in Congress to prescribe a new rule
of construction for that act. Pina'ly, the lar of the
last session was passed, giving in unequivocal lan
guage a legislative Interpretation to the act of 1357,
directly at variance wltn all the previous ratings of
the Department, and bearing upon Its face a positive
command for me to carry It Into effect. I have
simply discharged my duty, at the same time leaving
every other oillcer of the Government free to pursue
encu a course la the matter aa his conscience might
direct.
As no opportunity was offered me for defense In
the House of Representatives, 1 respectfully ask
that this letter, together with a copy of my report
upon the Chorpenning claims, may be made a part
of the report of your committee, and be placed upon
the flies of the Senate.
I am, very truly, your friend and servant.
John A. J. Cr as well.
. Having carefully read the foregoing letter or the
roBtmaster-Ueueral, I certify that Its statements
with regard to the submission of his leportlnthe
Chorpenning case to me for revision, and iny subse
qnent inter i lew with him, are strictly accurate.
Ft b. 4, ls71. Jamrb N. Davis.
OFFICB OK TtTB AUDITOa OF THB TitKAHURY FOR
the Po optica Dipaktment. Feb. 4, lstl I have
carefully read the foregoing letter of the Postmaster
General, and the statement made as to his conver.
sotloii with me In relation to the claim of George
Chorpenning Is strictly correct.
Mr. Creswell objected to Its payment out of the
regular appropriation for mall transportation, and
In reply to my remark that I did not see how It could
be nald from former appropriations. In view of re
cent legislation, be said that the question of Hading
an appropriation out of which It should be paid was
one which must be settled by the Treasury Depart
ment. J. M. MoOhsw. Chief Clerk.
To this letter is also appended a certificate of
Judge J. J. Martin, Bixta Auditor, attesting me
accuracy of all the statements relating to mm
self.
Tba Postmaster-General followed this letter
by a written application to the committee to
summon before it Hon. Jeremiah 8. Black,
George Earle, George Chorpenning, Hon. John
Hill, and Hon. John Cessna to testify as to Ms
attitude in the case; but the committee having
directed a report acquitting the Postmaster
General of all censure, it was deemed unneces
sary to comply with his request.
Not one dollar of money has beeu paid to
Chorpenning, and never will be now that the
act of ItsTO has been repealed.
