Simons, Esq., President, in tbe chair. The hall wan crowded. The new term of the United Slates Dis trict Conrt will be commenced on the third Monday in February. Neither the civil nor criminal list will include a large number of cases, and the most of the foimer will con sist of continued revenue cases. Preparations are being made to plane the iron roof on the bonded warehouse at Beoond and Gold streets. When it is completed, the building will be speedily put in a condition for occupancy. Lost evening the Finance Committee of Councils discussed the ordinance making an appropriation to the School Controllers. The committee disonsscd the qnostion , of an in creaHe of salaries, and heard an argument in its favor by Mr. lliche, but did not dispose finally of the bill. " The members of the Order of St. Crispin (shoemakers on ladies' work), now on a strike, assembled on Dock street, above 'Walnut, yesterday morning, to receive the amount allotted to them weekly, which is paid by a committee of the Order. The sum given is regulated by the number of persons .dependent upon the striking member. Mr. John T. Riley, victualler, well known in this city, died yesterday morning. He served in the late war, in the l'Jth Regiment, as a private for three months, and in the 00th, as Lieutenant and Captain, under Colonel Lyle. His military record was good. He fought in numerous battles iu Virginia, and was a prisoner in Richmond for several months. Mr. Riley was an active member of the Democratic party. Four years ago he was nominated for Clerk of the Common Fleas, but his competitor, Mr. Wolbert, was elected by a small majority. ' A meeting of those favorable to the abo lition of capital punishment was held last evening in the hall of the Mercantile Library, on Tenth street, above Chcsnut. Hon Eli K. Price presided. He introduced Mr. M. H. Rovee, who, in addressing the audience, as serted that since the abolition of capital pun ishmcnt by Michigan, Rhode Island, and AVisconsin, the crime of murder had in those States decreased. John I. Rogers, Esq., then made a short address; and at the close of the meeting a petition for the abolishing of capi tal punishment was circulated for signatures. A meeting was held last evening by the Temperance Blessing, at the Assembly Build ing, Jentn and Chesnut streets, to make arrangements for a series of temperance meet ings to be neld on the 2.'d of l ebruary next Rev. Mr. Torrence officiated in "prayer, after which the objoct of the meeting Vas stated by Mr. Heritage, who submitted a series of resolutions, providing for the appointment of a committee to draft a circular to be sent to all the clergymen of the c;ty and the presi dents or heads of various temperance eocie ties, urging upon them renewed efforts in favor of total abstinence, and requesting meetings to be neld by the churches and so cieties on the 22d of February next. The resolutions were adopted. The committees selected to try the con tests to the seats of the sitting members in Select Coancil, from the Twonty-fif th and the Eighth wards, met yesterday afternoon in Select Council chamber. The Twenty-fifth ward case was first token up, wherein Thomas (J. Jwans is the contestant and Samuel L, Snyder is the respondent. The committee was presided over by William F. Smith James Lynd and J. Alexander Simpson, it.sqs., appeared as counsel tor the con testant, and George Bull and Richard Lud low, Esqs., for the respondent. After the reading of the petition, Mr. Bull moved to quash it on the ground that it was not filed within ten days alter the organization 01 Councils, as required by the act of Assembly, Councils having organized on January Ikl, and the petition being filed on the 13th day of the month. The committee, after half a minute's consultation, overruled the motion to quash. Mr. Bull then moved to strike out the spe cifications charging that in certain division more votes are counted for respondent than he received; that the numbers of votes in the return were not written out in words, but were simply in figures; that a certain number of votes were cast for John B. Gallagher other than he received; and that certain votes were received and counted for respondent that were not legal. He based his motion on the ground that .they were irrelevant, as they did not show how the number of votes cast were to be determined; that John B. Gallagher was not the party complaining; that there was no allegation that the omission of the number of votes cast, written out in words, was fraudu lent; and, finally, that the persons who were said to be unqualified voters, it should have been alleged, were not registered voters, as the registry was prima facie evidence of a person's right to vote. The motion was sustained as to the striking out of the specification relating to the omis sion to write out the number of votes cast, and overruled as to the balance. Mr. Bull then hied the answers of the re spondent, which formerly denied all the alia nations contained in the petition. The returns and papers of the Iwenty fifth ward were then produced from the office of the rrothonotary of the Court of Com mon Pleas. The returns from all the divisions in the ward footed up as follows: Samuel L. Sny der, ll.ri3; Thomas C. Evans, 1070; John B. Gallagher. Il.'H. The tally list showed in the Fourth division 8 more votes for Mr. L,vaaa than he was credited with on the return, which would make his vote 10.8. Ihe cose was then con tinued until to-morrow, at 3 o'clock P. M. The Eighth word case was then taken up, i homos A. Barlow presiding over the com mittee. The contestant, II. Brinton Coxe, appeared, with Robert E. Randall and Isaoo Gerhart, Esqs., as bis counsel, and the respondent. Alexander II. Hodgdon, with J. Alexander Simpson, Esq., as his counsel. Mr. Simpson maintained that it was defective from beginning to end, as it was vague and uncertain, too imprecise, contained matters asserted on the ''best knowledge" of peti tioners, not alleged as facts, and other irreoru lurities,' and, as it repeated itself in separate specifications, it was open to the objection of duplicity; and further, that it did not charge any change of votes or fraud that affected contestant. Mr. Randall replied at length in support of tbe petitioners, and maintained that the coin- mittee having ueen urawn ana organized, could under the Act of Consolidation, enter tain no motion to quash, but were bound to proceed to the trial of the subject matter of the petition as they were sworn to ao, unless Hooner dittsolved. Mr. Gerhart followed, denying the nrisdio tion of the committee over this question, but granting thutthey had jurisdiction, they then would Hjt uj'on this -(Wbe iw conn, uming io determine a demurrer to tbe "petition, and it is a cardinal principal of law that one who demurs to a document admits all its facts, though of late courts have followed the libe ral rule of allowing those against whom they have decided a demurer to withdraw the de murrer and plead over, He then argued that the reasons set up to maintain the motion to quash are so vague and incongruous in them selves as not to entitle them to attention, and the whole of his opponent's argument was based upon an assumption of facts, which there was nothing to show existed. Mr. Wilson offered in the Senate yester day a resolution granting $2000 per annum as a pension to Mrs. Lincoln. A boy was burned to death during a fire in Wall street, N. Y., last evening, and his parents were severely injured. It is claimed by the friends of the Presi dent that he did not receive Fisk fc Gould's agent when lie was at Washington, Pa., last summer. An accident occurred on the Watertown, Rome, and Ogdensburg Railroad last even ing. Your remarks in a recent issue of The Tr.LEORArn regarding the popular feeling against the income tax is eminently correct. It is amazing that the press does not allude to this tax, in its unpopularity, more constantly and persistently. Still more surprising that our Congressional representatives manifest so much indifference as to its immediate repeal, or at least to its discontinuance at the time of its limitation. Without referring to its tyranny. despotism, and bold and unblushing exposure ot private ana sacred rights, 1 will only endorse your assertion, that if it is not immediately repealed thousands of votes will be lost to the Republican party, and, should it be continued after its limitation, thousands of votes more. VI my own know ledge I could name quite a number of cood. sound Republicans who did not Vote at the last election, ana who nave, over and over again, asserted they would not while this abominable law was in existence. I am a Republican ; was with the party from its first organization; but I did not vote for the party last fall, and moat posi. lively vm not annm, until this obnoxious and tyrannical law is repealed. 1 am not alone. A more despotic assumption of power was sever heard of in a free government. If tyranny! and exposure of sacred rights is to be the key note, we may as well live under a monarchy. Unmanly speaking, as sure as the sun shines from a cloudless sky will this law defeat the party. Wisdom on the part of our legislators would suggest an im mediate repeal. Will they listen to its voice ? What right has our Government, formed for protection, to injure a single individual by an exposure of his private a$'airs, for luore than one has been thus injured, individuals of honor ond iitegrity ? What right has it to give permission for a publication of its list ? Exasperation is deep and loud. Patience is exhausted, patriotism is disgusted, and confi dence lost. A change will be sought, and had, too. filar K the signs ot tbe times. Asa journalist you receive full credit for your editorials on the subject.
