On the day following, four of tho directors Mr. Ilarry Conrad, the President, and Messrs. Ihhiu: C Kendall, Charles 1, Anthony, anil .Tames Hoy appeared before Police Justice fad with, and ma le oath to a complaint preferring a criminal charge against Mr. lvtmnld. Ten days afterwards, upon a warrant. Issued on Unit complulnt, Mr. Detmold whs arrested. A protracted investigation followed before the magistrate, in the course of which vast volume of ' evidence was introduced by the prosecutiou, consist ing chiefly of their own testimony. Mr. Detmold offered no evidence, but rested the case ou the com plainant's proofs and his own written statement ex planatory of all tho circumstances which had been urged against him. And in this form the case was sent by the police magistrate to the Court of Gene ra! Sessions. Immediately upon the .record being filed in that court, Mr. betmold's counsel moved to dtsckargo bis recognizance, upon the ground that the raso made by the prosecution established his In nocence. This motion was argued at length at the March term before Recorder Ilackett, bv Mr. Choate in behalf of Mr. Detmold, and by Mr. Clinton, with whom Mr. P. B. Katon also uppeared for the prose cution, ami the Recorder yesterday delivered and Hied the following opinion, which cannot but be a source of congratulation to the many friends of tho party accused, who has long been one of our most esteemed citizens: "The People agt. Christian K. Detmold and Charles O. McCord. Motion by the defendant Detmold to be discharged on bis own recognizance. That the counsel lor the prosecution regard tho mutters of alleged fact in Ms case as complex, and the law questions as sJiwhat Intricate, is apparent from the printed brief of more than one hundred pages which he has filed. The testimony Is voluminous, and counsel for the defense has been equally Indus trious with the magistrate's clerk and the legul ad versary In his preparation of argument. I have rend all the evidence and arguments with great care, and aa they are filed herewith refrain from re capitulating any portion of either. I have no doubt of the entire Innocence of the defendant Det mold, that he is guiltless of any offense. That he may be amenable to the charge of having been deceived, and, perhaps, of having been too confiding In an agent, la only to say what often happens to the best business man conducting large operations. The motion to discharge the defendant on his own verbal recognisance la granted. I cannot, of course, control the action of the District Attorney, who may, if so disposed, aend the case to the grand jury; but I even now treat this case as if I was about to charge Jury on the allegations before me, which are con ceded to be all that can be stated. I cannot resist the conviction that If the defendant Detmold had not commenced a civil Bult against the compauy, this complaint, Initiated eleven days afterwards, would not have been preferred. I have always been as a judge averse to criminal tribunals being made instruments either to further or delay pecuniary set tlements. Let an order le entered by the clerk in conformity with the above.
