THE DAILY EVENING TELEGRAPH P HILA D ELPHI A, THUHSDAY, JUL? 30, 1868. A LEGAL ROMANCE. The Ilonse of Lords, sitting m a Court of Appeal, have flAllj disposed of n case which baa troubled the Court, ol Law Id Scotland, with more or lews of Interruption, for the lutt thirty yfari.Tt.d which, In some or Its phases, presents ClroamstutiCit as romantic as aoj of those that era to be found In the French caute$ celebre$. The Scottish earldom of Hiirliug, which was crsated, we believe, iu the rsifcn of Charles I, and which whb endowed by that monarch with toisessions in Nrtb Anierlia, equal in extent O a European kingdom, together with the rnvilege ol granting patents and creating digni its, such ni are usually considered to bo sacred to royalty alone, is now finally cxtlrtsulshed. The title, Inoeerl, has been doramnt for many years or, rather, It has been In that semi vital state In willed a person lays claim to It without having the power to make his title pood; while, at the same time, he is ullowed to assert it because no one has an interest In disputing Lin claim. Moro than one of the Old historic titles of Hcollnud have thus Mien into abevnnce, and bave been picked tip aud Worn, with more or les of genuine belief In tbelr own right, by Individuals of the humblest rank. Our readers will no doubt be familiar with the story told by lluh Miller of the hod mm iu Edinburgh ho claimed to be the lineal descend ant of the old Em Is of Craufurd, and whose as sertion was admitted, while It was ridiculed by the masons, who delighted to call to him: "John, Enrl ol Craufurd and Lind.-ay, brlnme another hod of lime." The claims.!, Is of the Earldom of Stilling bad not fallen so low in the social seal'-; on the contrary, they had wealth and wonlthy friends, and it was their determi nation to bring their right, not to the title only, but to the more semi-royal rights conlerred on that title by the sovereign, to the decision of the courts of la, that first moved the Crown to Interiere and remove the investigation of the case from the civil to the criminal courts from an investigation of the pedigree of the claimant to an accusation that the principal documents on which he rested hi claim were arrant forgeries. The documents on which the claimant rested his title were of a lingular character, aud they bad as einzular a history. They had been pro cured In J-'iance through the medium ol a tor-tune-teller, who was ot great notoriety in Paris In her day, and whom the wife of the claimant Lad gone to consult about the chances of the success of her husbund's claim. Long aud mys terious communings took place betweeu them, the issue ol which was that the Parisian nby I not only- tiedicted speedy aud orilliaut success, but rendered more substantial ana worldly aid by liiroifcLing documents which, if genuine, placed the reality of his title beyond doubt. These documents were produced in the Court of Session, and the nntural consequence whs, that on, the laith of them he was served heir to the title. Cut on their produc tion, strong doubts of their genuineness eprung up in the minds of the law officers of the Crown, who, of coure, wtitthed with a Jealous eye the progress of a suit that was to place a subject on u level with the sovereign in the granting ot piv'.ents and creating dignities in a portion ot her dominions. Secret, and searching inquiries were But on foot in Paris; and enough light was thrown on the transac tions to induce the Lord Advocate of the day to indict Sir. Alexander, the claimant of the case, before the IPeh Court of Justiciary, for the crime of forscry. The document ttiat were brought forward to establish the claim were now used to demonstrate bis crime; aud many "Witnesses were brought from Fruuce to testify, not only to the bpuriounf s of the documents, but also to the manner in which the forgeries bad beeh manipulated. One piece of evidence was remarkable for the subtlety, precision, and fulness with which forgery was shown in a case where at first sight there seemed to be no po nihility of fraud. It was an old map of the Canada, drawn at a time when Canada was in the possession of France, and which, it was averred, had been In the possession of Louis XIV. This was evident, for on the back of it were written some remarks by the king's own hand in reference to Canada, and to the adjoining English province ot Nova fscotia. Tbcmap indeed, seemed nave patted through the hands ot all the PurU celebrities of that period, lor not only had tho king scribbled on the back of it, but Bosquet, Alizarin, and, indeed, the whole Court circle had followed tho royal example. And, what was still more re markable, the notes ol every one of them bore relerence in one lorm or other to the extensive rights in North America, granted by the charter of the English monarch to the earldom of Stirling. The map purported to be zecuted in a given year by au engrater who st) led himself map-maker to the kin?. So far all was clear. It was curious that all these royal or courtly personages should have so fall a knowledge of the rights of the Stirling family, and should take so much interest in their lor tuneB, but plausible reanous were given why they should do eo; and it was impossible to tirove the negative, But from out of this appa rently solid and compact evidence the incenulty of the Crown lawyers culled the means ot Its complete destruction, aud the tearing to tatters of the whole cleverly constructed evidence in the case. A witness was brought iroru the French archives in Paris, who proved that at the dale ot the map, as given in tho margin, the engraver did not enjoy the title ol map-mukerto the king, aud that he diul not attain that honor till several years afterwards, m the following teign. To explain the discrepancy which was thus apparent between the title uud the date, the witness staled that it was common in France, as we believe it is in this country alto, to ci grave on the plate lrom which the map is printed evi ry new honor to which the euerraver attains, hammering out, If need be, any preriouB honor be may have held, but not altering more than is accessary, aud especially leaving the date ot the year when the plate was first engraved untouched. That it was plain to demonstration that the particular copy of the map on which the prisoner relied could uot pos sibly have been printed uutil the engraver had attau.ed tho oflice which it certiUed; aud it was clearly proved that at that date all the illustri ous persons who had written tneir comments ou its buck bud been long dead. The evidence was conclusive the forgery was palpable. But it wa-s not so clear who was the forger. There was great sympathy lelt for the aged prisoner, as be gtood there in the lolou's dock, charged with a crime of which those who knew him uiobt iniimaicly believed hiui to be incapable. This was shown in a touching manner by the appearance bv his side Iu the dock of that distiuguiobed military officer, Sir Charles d'Albrac, the then Commander of the Forces in Ireland, who came over expressly to testify to his belief in the character ot hU friend. The trial lasted for several days; aud day by da, as duly as the piisoner was placed at the bar, the grand old soldier, in the true spirit of chivalry, took his place at his file, llis appeal ance could not but have its etlect on the jury; and besides, while the evidence was full sna precipe as to the forgery, and while it wentlnrto implicate some other members of the prisoner's inrnily in suspicious dealings With the fortune-teller, there was nothing to militate neamst the idea tout the prisoner him self w as the dupe ot cleverer and lef-s scrupulous wits than hi. own. The verdict was given In that spirit. The jury found that the docu ments relied ou were palpable forgeries; but they acquitted the prisoner of all guilty knowledge of them as loigeries. When the prisoner heard this verdict, winch, while it cleared his moral character, shuttered all the hlirb l ope-; of honor and dignity ho had entertained, nature gave way, and he fell fainting Imo ihe arms of bis frieud. The piisoner was, therefore, set free, but the documents on which the trial had turned were impounded, and In the following year an action ol reduction was brought upon the service of heirship, which he bad oMaiued in the pievious year. This was iu Win, ttnd from thut time 1he matter has slept till a few months a?o, when the sou or Mr. Alexnuder proposed io carry on the appeal In the House ot Lord', against the decree of reduction in the Court ot Hei-sion, which bad been triven notice of thirty years before, but never prosecuted till now. His claim was udmitted, and the case was lietird ; but tho case on its ow u air rite was alto pet her untenable, mid the appeal was dismissed with costs. We muy, then-lore, assume that now at leat-t wo have heaid the las', of tho claim , to the Earldom of Stirl.ng, and its seiui-rovul privileges across tho Atlautlc Vie London fceotsman. SHIPPING.
