A majority of the corporators were not present, and
the statute does not give authority to a corporator to

Third The supervisors having been created at the

OHl! OPINIONS OF SAMUKt, C. PERKINS AND (I, W.
U1UULE, KSQ.S.
To the Gettysburg Asylum for Invalid Soldiers:
There have beeu submitted to us, by members or the
Corporation, a letter dated the 4th instant, addressed
to Brigadier-General H. G. Sickel, Treasurer, by Hon.
Benjamin Harris iirewster the Attorney-General,
together with the Act ot Incorporation, passed by the
legislature and approved by the Governor March 8,
167; also the minutes of the meeting for the organiza
tion of the Corporation, and the By-Laws adopted tor
its government.
There Is a perfectly plain legal method of test
ing any one of tbe questions involved in the letter
ol the law officer of the Commonwealth, or which
tie may desire to raise under this Act of Assem
bly, and we cannot but express our surprise that
the public press should nave been nrtde the
vehicle of attack upon the corporation and individuals
connected with it, instead of resort being had to the
courts of Justice. We are further of opinion that the
character ot some of the articles which have ap
peared in print are essentially libellous.
Our advice is that tbe Corporation and Its officers go
on under the act, and use all such legal remedies tor
the maintenance, defense, and protection of their
rights "as may from time to time fipem exned en '-,
Very respectfully, SAMUEL C. FERKIXs,
GEORGE W. RIDDLE.

"A. Ward" was looked upon for some time as
