WHAT 18 MARTIAL LA Wf In hie recent charge to the jury in the caso of Colonel Nulxon and Lieutenant Brand, indicted lor the murder ot Mr. (iordon, in Jamaica, Chief Justice Cockburn discussed at great length the history of martial law In Kueluud. He proie.eed himself shocked and alarmed at the loose detini tiona which are commonly received, and thought It high time that they were brought to the test of a judicial interpretation. He con tended that tnere Is a broad distinction to be made at the outsturt between a rebel in arms and a civilian who becomes in any way ame nable to martial law. The trial of the Earl of Lancaster, in the reign of Edward II, was not a case of martial law, uttboucb, irregular. There may be some doubt about the Wat Tyler insur gents, In the reign of Richard II, but it was thought necessary to oblaiu an act of indemnity. In the reigns ot Henry IV and Henry VI there were frequent irregular executions, but the first instance ot martial law, in its modern sense, was the prosecution, after the battle of Stoke, of the wealthy adherents oi the Sinuel rebellion. Henry VII, however, wanted money much more than blood, and very few were executed. The trials were illegal throughout. The rebellion was suppressed, and "it was certain that you could not bring men to trial under martial law alter rebellion had been suppressed." In the reien of Kuwarcl VI the disaffected were in the habit ol raising the villages by the sound of church-belli, ana according to a pro clamation contained in "Strype's Ecclesiastical Memorials," this attempt to muster men in arms was forbidden under pain of death, to be exe cuted by the authority of law martial, whereby no delay should be permitted as in other cases. "This was a strong proclamation, but it was entirelv ultra vires "tor the Crown to have dealt with these oilenscs otherwise than by act of Parliament." Again, in 1549, according to SUvpe, lordlieutenants in various counties were empowered to exercise martial law. In 1562 there was a proclamation ot the same kiud. Lord Hale said th-.it such proclamations were olten issued fn terrorem poputi, without any intention of carrying them into effect. Another proclamation was issued in the reign ot Queen Mary in which martial law was threat ened against those who imported heretical works, and, if Hume was to be believed, this pxnmrile was followed bv Oueen Elizabetn, who proclaimed that those who imported bulls or traitorous works from Kome should be punished with death under martial law. Again, upon a representation from the citizens of London con cerning apprehended riot, the Queen issued a commission authorizing the establishment of martini law, and the execution under it ot all riotera, and declaring, with an extraordinary stretch of assumed power, that persons wno were leading vagrant lives, and could not give a good account of themselves, should be hung up. This was an entirely unconstitutional pioceeding. . , James 1 and Charles I i-sued commissions for courts marital, but the Petition' of Right pro nounced these commissions unlawful, and solemnlv asserted that no English subject was to be subjected to martial law. The doctrine has never since been contra dicted in practice. The Chief Justice, added, that having exa mined every inManco in English history in which martial law had been referred to or pro claimed, he could find no such thing as martial law used for the purpose of putting down re bellion. He wa9 therefore utterly astonished to find persons Ki authority and out of it, talking about martial law in an easy familiar way, as a thine perfectly understood and set tled in Eneland. when, in truth, it Lad never been resorted to or exercised. The special correspondent of the London 7 imes at the French Inhibition says that coral has risen enormously in estimation as an arti cle of jewelry. Pieces that live or six years ago would have sold at twenty shillings au ounce, now letch one hundred times that sum. Formerly, too, the dark red coral was the most esteemed; now it has yielded the place of honor to the rose-pink variety. Whether this new taste is a mere ephemeral caprice that will die out, remains to be seen; but it is certain that coral, which but a few years since held a secondary place as an article of personal ornament, now commands in the rough a price equal to about twenty times its weight in gold. llev. The Bristol (England) Daily Post hears that, about three years ago, it was stated at the Wes leyan Methodist Conference that funds were urgently needed to build chapels at several watering places, aud to repair others, upon which the Rev. Morley Punshon rose and stated that he believed he could, with God's help, and in the space of three years, raise i.10,000 by lecturing, the proceeds to go to the object just alluded to. He ha3 already so far fulfilled his promise that he has paid iu 9000, and has got half way through the last JU10U0 required to complete his engagement, so that by next Conference the required sum will be made up. A Rival to Dr. t'uinmlng. A rival to the prophet of "The Great Tribu lation" has appeared in Germany. He has printed a book under the title of the "End of Napoleon III ! Division of France ! l'rophecies from Holy Writ on the 'impending great Rhenish War, the fall of Napoleon, the break ing up of France, the fate of Germany and of Prussia, of the whole Rhiue and Westphalia, of Pius IX, etc. etc." This is the third instal ment of a series of interpretations of prophe cies, each to be had for the moderate sum of two and a half silbergroschen. The Bible In Poland. The British and Foreign Bible Society, after long and unsuccessful endeavors to obtain a footing in Poland, has at last received permis dion to sell the Bible. A deposit for the sale of the Scriptures has been opened at Warsaw, and, though no publio notice had been given, such was the excitement connected with the opening lhat on the firct day 1019 copies were sold, producing nearly jL50, and during the first week lhe j)un.Laoi amounted to 3172 copies.
