' To-day was devoted to speech-making.
Mr. Cook (111.) arpued that tho power of rc
oojml.iui? the seceding States as in the Union
rests witn (ongrress. When the military power
can saleiy be withdrawn, and thpse States re
main peaceably in the Union of their own
accord, and not by force, and tho Union men
and trcedmcn do not require a military force to
piotect tncjn, the civil Government should be
recocnized; but no military power could set
aBide the enactments and jiJdicin' Meciions of
the States fully in the Union. While these acta
were necessary, the State bhould not be recog
nized. Judge Lawrence, of Ohio, maintained that the
ordinances of secession were null and void; that
no Sta'c was ever out of the Union, but that all
lawful State government was destroyed in the
Itehel States; that when the Rebel governments
were overthrown the people were lelt without
any Slate novernrucnl; that it is the duty of
Conprss to guarantee it, and until this is done
there can be no lawful State government and no
representation in Congress.

The weather is still very cold. Ice has formed
to the thickness of eight inches, and skating is
excellent. Ec3
Tne 6ttck market is strong this morning, and
Governments are firm. Cold opened at 1374,
weak. The depression in gold is plaving hoo
with the markets. Everything is dull, and prices
have a downward tendency. ,;
The Hon. Benjamin F. Manierre was yesterday
chosen a Police Commissioner by the Legisla
ture, vice William McMurray. Mr. Manierre did
iot f jmpathize 'with the rioters who burned the
Colored Orphan Asylum in July, 1803.
During the past week the Surrogate has ad
mitted to probate tho wills of the following
named persons: Thomas T. Guion, William
Webb, Lawrence Lennon, Ebenezer Seelay,
John bell, ' Ann liurrell, Catharine Bait,.,
Anne B. Griswold, Euphemla Ogdeu. None of
the above. wills contain any provisions of public
importance.
The will ofrWilliam W. DeForest bequeathes
to tho New York Magdalen Benevolent So
ciety. $3000; to the Society for the Relief of
Half Orphan aud Destitute Children, $51)00; to
the Port Society, $5000: to tho American Bible
Society, $0000; to the Trustees of Yale College,
at New Haven, $2000.
Tho action entitled Matilda A. Moody vs.
George A. Osgood, which has been on trial in
the Supreme Court Circuit, before Justice Foster
and a jury, for the last two days, was concluded
yesterday by the jury rendering a verdict for the
plaintiff of $3500, on which amount the
Court, on motion of plaintiff's coun
sel, granted an extra allowance of five per cent.
Thirty duj6' time was given for defendant to
make up a case on appeal,
Tlie number ot valentines set down as deli
vered on the 11th and 15th instant is over
C3,000, which docs not include the very many
thousands under the modest wrappings of the
ordinary envelope. Doubtless the number of
these missives of love or lolly and frolic will
reach 100,000. Who would believe there were
so many malcontents in these peaceful times?
Application was made yesterday in the Su
preme Court, before Judge Ingraham, by John
Murphy, Receiver ot Taxes, and O. Sloan llolden,
City Tax Marshal, that the Receiver of tho
Marine Insurance Company be directed to pay
out ot the tundfl of the company in his hands the
tax imposed upon the company in 1ku6, amount
ing m all to one hundred and two thousand
dollars, in preference to all other demands. The
