Under Senate Bill 1413, townships challenged in similar cases could be required to pay if the ordinance is ruled il legal. The farmers also seek reimbursement of attor neys’ fees from the township and the supervisors personally. The defendants filed prelimi nary objections to the complaint in March. Briefs were fded by both sides, and the court heard oral argument in June. On Sept. 12, the court denied the defendants’ preliminary ob jections and held that the farm ers’ complaint is not defective. According to the court ruling, the plaintiff farmers have standing to sue and the defendants could possibly be held liable to reim burse attorneys’ fees. The supervisors could possibly be held personally liable to pay the fees, depending on the ulti mate set of facts developed in dis covery.
