WASHINGTON, D.C. NFU has urged a federal judge to reject a proposed agreement that would allow grain giant Cargill, Inc. to purchase a com petitor Continental Grain, Co. NFU said the deal would adversely impact net farm income. The judge is reviewing an agreement between the Justice Department and Cargill that would allow the merger if a number of divestitures are made. The judge has to deter mine whether the deal is in the public interest. In comments filed recently, NFU said even with proposed divestitures the deal will signifi cantly erode competition for farmers selling their grain, mak ing it nearly impossible to earn a fair price. It must be stopped.” NFU also said the mandated divestitures would be difficult to enforce. “There is not guarantee a buyer can be found for these divestitures. Moreover, there is no guarantee a buyer will be in a position to compete with a farm the size of Cargill,” Swenson stated. “There are no safeguards for competition." Merger Cargill and Continental col lectively control roughly 40 per cent of all U.S. grain exports. Lack of competition in the export market affects producers because they depend heavily on export sales and because the domestic market is influenced by the world price. The Cargill- Continental merger will only exacerbate these problems, NFU noted.
