Strock Extension Agent Farm Management Death and taxes may not be anyone’s favorite topics, but con sumers seem more willing to plan for them than the illness and disa bility that may occur anytime. Most people are sensible and stoic enough to accept that they will eventually die. Consequently, they plan for death by having a legally valid will. However, most people seem reluctant to provide for someone to take care of matters while they are still alive but incapable of managing their affairs. A legal guardianship assigns the financial responsibilities of one person to another, enabling the guardian to have access to bank accounts and other invest ments, pay bills, make purchases, and in general take care of the ward’s financial transactions. People who need a guardian because they are physically or mentally unable to manage their finances get one by two methods; 1.) They can assign one them selves or secondly, 2.) Do nothing. By doing nothing, the person is leaving this important decision in iAgwa Farm, Horse or Commercial Complete Package Buildings Custom Designs Highly Detailed CAD Blueprints Engineer Sealed Prints Available Erected Building available through Independent Contractors For Information Call: 1-800-258-2096 Agway Buildings, P.O. Wnen a court decides, they consider kinship and geographical proximity. Even so, the court may appoint a guardian that the person would not have chosen for themselves. In addition, a court-appointed guardian faces a tremendous bur den of paperwork and bureaucra cy. Each purchase and many financial transactions must be jus tified to the court’s satisfaction. Using the ward’s money to pur chase a new nightgown for an incapacitated sister can become a nightmare of paperwork and run ning around for the court appointed guardian. The solution is easy. With the help of a lawyer, perhaps the one who wrote your will, draw up a simple, durable power of attorney that will assign responsibility to a guardian of your choice. This makes things easier for the ward and the guardian. The problem with a durable power of attorney is that it can be drawn up only when the person is still capable of making important legal decisions. When you’re incapacitated, it’s too late. So protect yourself and your family by drawing up a durable power of attorney. Why not do it today? Buildings- AGWAY
