At that time we were expecting to go to trial in the near future on racque teering counter charges that the association filed against Wagner in 1987. However, the federal judge in the case subsequently ruled that the association’s expenditures for legal fees and other out-of-pocket expenses did not constitute dam Delegates’ District Meetings Held Five district DHI association meetings were held last February and March. A total of 121 member delegates attended the meetings to hear state directors and manage ment staff report on the status of DHIA business and provide feed back about the direction of the association. The subjects for discussion included an update on the progress toward providing nutrition and for age analysis serviced, testing milk samples for the presence of Staph, aureus mastitis, and a new labor efficient records program; a review of PA DHIA goals and the association’s budget for 1990; ser vice statistics for 1989; the pur pose of and progress toward reor ganization; and plans for upgrad ing the training program for DHIA supervisors. In more recent developments, the Commonwealth Court ruled on an appeal of a decision in Centre County Court that found the asso ciation had not followed due pro cess when Wagner’s official pri vileges were suspended for five years and the official status of his records was canceled. This development brings to an end another string of legal chal lenges that Mr. Wagner originated against the association and sub stantiates that Pennsylvania DHIA has the right and the ability to enforce its rules and bylaws. One case in Centre County, a counter claim against Wagner for fraud, remains to be resolved.
