SLAUGHTER HEIFERS: AN OPEN LETTER TO OUR CUSTOMERS AND OTHER CATTLE SHIPPERS Dear Cattle Shipper: The purpose of this letter is to put an end to the many false and misleading rumors which have been circulated by a few supporters of the illegal Beef Check-Off Program. Also, I want to inform you on how we can get this law overturned. Let’s start with setting the record straight! A complaint was mailed to us approximately February 2, 1987. We knew it was coming and I personally spoke with the U.S. Attorney who sent it. This conservation took place three days before it arrived. The complaint, basically, is a request from the government to us to comply with the Beef Promotion and Research Act. In essence, the government wants us to do what all other “collecting persons” are now doing. That is, they want us to (1) file reports, and (2) collect assessments. Nothing more and nothing less. Any accrued assessments and/or penalties due from the beginning of the program will be paid by Vintage Sales Stables if we should lose this case. This means that no farmer who has shipped cattle into Vintage or will ship cattle into Vintage will be responsible for any amount due to the Government or the Beef Council. 2. Vintage Sales Stables, Inc. will remain open for business as usual this Tuesday and every Tuesday long after we have defeated this law! Paragraph 27 of the complaint requests that Vintage be enjoined “from operating a cattle auction... without complying without (the act)”. This means that if we were to lose in court (and we have not come this far to lose) and still would not comply, then and only then could the government stop us from selling cattle. However, if we lose (and the appeal process could take years), we would definately comply with the act and no shut down of Vintage would occur. 3. No penalty is sought; no injunction is sought. Even though the act provides for $5,000 penalty, no penalty was asked for in the complaint. Nor did the government even attempt to ask the courts to shut us down. Therefore, any immediate shut down or penalty against Vintage Sales Stables has been precluded. As we have made known, we need all of your help to have this act repealed. Now, what can you do to help defeat this law which takes money out of your pocket and puts it into the pockets of the Beef Council? First, a legal defense fund has been established to accept any donations which would be sent to us for the reimbursement of attorneys fees and advertising expenses. At this time, approximately $2,000 has been committed. However, any amount, no matter how minimal, would be greatly appreciated. Second, I have met with our Congressman to discuss the possibility of reopening hearings and repealing this law. However, this can only be done with your help. We are beginning a mailing and telephone campaign to show our federal congressman that you oppose this act. Whenever any legislator receives more than 500 pieces of mail on one topic, they react quickly! A letter, post card or telephone call to your Congressman is not only crucial, but is the most powerful way of having your voice heard. After all, how do you think the Beef Council pushed this law through in the first place! Please, please, please send a post card or letter to your congressman requesting him to reopen hearings on this law!!
