Breneisen em phasized that an E&S Plan must be followed during any type of earth moving activity, regardless of scale, from backyard gardening to development. Beginning in 1981, the Depart ment of Environmental Resources transferred the E&S Control Program to the Bureau of Soil and Water Conservation, and con servation districts were permitted to become involved in handling erosion and sedimentation violations through participation in up to six ‘ ‘levels of involvement. ’ ’ Level one involves nothing more than receiving complaints from individuals, municipalities or government agencies, while level two involves an actual site in vestigation to determine the severity of the problem and who is responsible. Levels three through five entail increasing levels of involvement by the district in an effort to achieve voluntary compliance to E&S regulations. Level six, the final level of district participation, involves actual legal enforcement of Chapter 102 of the Clean Streams Law. Northampton is the only other conservation district in the state involved at the enforcement level, according to Breneisen. The majority of E&S complaints in Lancaster County are handled by Breneisen, who reports that he received about 50 complaints during 1984, with peak periods occurring after thunderstorms and other periods of heavy run-off. Noting the magnitude of the erosion problem in Lancaster County, the speaker said that he has little time for initiating his own investigations, and is kept busy answering complaints registered by others.
