Farmers Union has retained
counsel to plan litigation against
USDA’s Secretary John Block to
stop collection of the 50 cents per
hundredweight tax Against dairy
farmers’ milk sales, according to
Carl Kaufman, PFU’s executive
director. He said the law firm of
Solter and Chopivsky, Washington,
D.C., will handle any action
Farmers Union may bring.
Kaufman said actual filing of the
suit will wait further developments
in the cases now pending against
USDA. He said that South Carolina
Federal Judge Matthew Perry’s
decision Monday granting a
preliminary injunction against
USDA is good news for Penn-

derstood that USDA plans an
immediate appeal.
Judge Perry’s decision was
based on procedural errors in
USDA’s regulations for collecting
the 50 cent levy. USDA will start
over, reissue the regulations, give
the necessary opportunity for
public comment, etc. and expect to
start collecting the tax within a few
months, if the Department loses
the appeal from Judge Perry’s
decision.
Kaufman said that since the
procedural defects can be
corrected, further legal action will
probably be necessary soon in

order to prevent USDA from being
in position in a few months to start
collecting the levy. He said many
experts who’ve looked at the law
feel it is unconstitutional and
vulnerable to attack on that basis.
A number of suits are pending
against USDA in other states to
stop the levy. These suits are
founded on several kinds of
complaints.
Kaufman said that while PFU
does not relish the idea of incurring
the substantial cost of litigation, he
and the officers feel an obligation
to do everything possible to help
Pennsylvania dairy farmers fight
off this confiscatory action.
