He said the law firm of Solter and Chopivsky, Washington, D.C., will handle any action Farmers Union may bring. Kaufman said actual filing of the suit will wait further developments in the cases now pending against USDA. Judge Perry’s decision was based on procedural errors in USDA’s regulations for collecting the 50 cent levy. USDA will start over, reissue the regulations, give the necessary opportunity for public comment, etc. and expect to start collecting the tax within a few months, if the Department loses the appeal from Judge Perry’s decision.
