Maryland’s Senator
Mathias introduces
ag preservation bill
ANNAPOLIS, Md. -
Senator Charles McC.
Mathias Jr., of Maryland,
last week introduced
legislation encouraging
farmers to resist the
pressure to sell their land to
developers and to keep their
land in agricultural
production.
The Farmland Develop
ment Rights Act would offer
tax advantages to farmers
similar to those now offered
to homeowners so they will
participate in state
programs designed to
preserve farming land.
Mathias said his bill tracks
programs in New York, New
Jersey and Maryland where
farmers can sell the
development rights of their
property to the state. The
state purchases an easement
on the property which
prevents the owner from

using the land for any other
than agricultural purposes.
“The sale is theoretically
in perpetuity but the farmers
may buy back the rights
after 25 years if it can be
shown that profitable far
ming is no longer feasible,”
Mathias said.
The Mathias bill will allow
a farmer to use the proceeds
of these sales to buy more
farmland without having to
pay a capital gams tax. It
will also allow a one-time
only tax exemption of
$lOO,OOO if the farmer is over
55.
Mathias observed that
since the states have limited
funds available for these
programs, the development
rights are often sold for less
than market value.

financial gap by allowing the

Mathias said discussions
with Senator Jim Clark,
President of the Maryland
Senate, convinced him that
action at the federal level
was needed to keep far
mland m production.
“Unfortunately, our
country’s farmlands are
being converted to non
agncultural uses at a rate of
over three million per year,”
Mathias said. “In the last
decade alone, this ur
banization process has
swalloped up land the size of
West Virginia.”
“If the United States is to
remain the world’s leading
exporter of agricultural
products, we must act now to
encourage American far
mers to continue farming
their land,” the Maryland
Senator said.
