Department of Justice. The consent order was signed by officials of Agri- Mark, H.P Hood Dairy, and Agway Inc. The three are parties to the formation of a giant New England dairy cooperative. The Justice Department had stalled the proposal while it investigated any possible improprieties in the new deal. Under Wednesday’s consent order Agway, Agri- Mark, and H.P. Hood agreed to have no common direc tors, officers, or management. The full-supply provision proposal, whereby Agri- Mark agreed to supply all milk for H.P. Hood, was cut from a 10 year duration to a one year contract The contract will be renewable annually. Of course, Agn-Mark will be producing far more milk than H.P. Hood alone can handle.- A further provision of Wednesday’s consent order with Justice is that Agn- Mark will supply other handlers and that all buyers of Agn-Mark milk will be treated equally. This is standard procedure When the parties involved agreed to all of the above operational modifications and several other provisions, the Agri-Mark Co-op became operational. The full text of the agreement will be published in the Federal Register. Following publication, there will be a 60-day period for comment Following the comment period, the judge will make a final decision on the con tinued operations of the co ops and firms mvolved. Barring any major ob jections from outside, the partnership should be completed and free to run at that tune. Agn-Mark was to have an annual production of three billion pounds milk for the deal to be completed. That condition was, for all practical purposes, met at the end of June, according to those involved in the deal CH $2.46/bushel for the crop if stored on the farm or in a USDA approved warehouse. Program eligibility requires that farmers report their crop acreage to ASCS by August 1, 1980. The program provides free in surance against crop failure and commodity prices.
