Ph : 717-656-7702 on Farmer Meat Selling Regulations involving the handling and sale of meat by farmers have undergone exten sive change in recent years and particularly in recent months The following up-to-date statement on the situation was released jointly by H. Louis Moore, Penn State marketing specialist, and Max Smith, Lan caster County agricultural agent; Shortly after the turn of the new year Pennsylvania became the 16th state to achieve meat inspection certification “equal to” federal inspection. To earn this status Pennsyl vania had to develop a law and regulations, financing and staff ing, as well as actual inspection which matches the federal in spection program conducted by USDA. The Wholesome Meat Act passed by Congress in Decem ber 1967 gave the states three years in which to comply with federal standards. Many other articles not mentioned. Kreider andDiller, Aucts. The Cuitis Amendment to the Wholesome Meat Act was signed into law by President Nixon m mid-1970. This amend ment does permit exempted custom slaughterers to handle meat commercially in the same establishment. This means that plant can custom slaughter and process animals owned by customers without ante or post mortem in spection. After the custom slaughter kill is completed a clean up is required before the plant can resume regular slaughter under inspection. Producer exemption; Under the earlier version of the Penn sylvania meat inspection law producers were permitted a wide slaughter and retail ex emption. The General Counsel of the U.S. Department of Agri culture contacted the Pennsyl vania Department of Agricul ture pointing out that the pro ducer exemption provisions of the state law were much broad er than those permitted by the federal act: Under the original state exemption, “farmers who slaughtered their own animals 11:00 o'clock Terms by, MRS. GOOD Lancaster Farming, Saturday, March 13,1971—35 15, 1971 for home use or sold exclusive ly at retail were exempt ” This permitted farmers to slaughter their animals and still retail at the farm, at farmers markets or door to door without inspection. The State Attoiney General ruled that the fedeial govern ment has preempted the field with respect to meat inspection and that the federal producer exemption which “permits the slaughtering by any person of animals of his own raising, the meat and meat products of such animals to be used exclusively by him and members of his household and his nonpaying guests and employees,” become the new producer exemption m Pennsylvania. With this new exemption the original intent of the 1967 fed eral law, “that all meat offered for retail sale will come from inspected plants,” will be ful filled. The narrow producer exemp tion now in effect does not per mit producers to retail unin spected meat. Producers who wish to con tinue to retail meat must take their animals to a plant where the animals are slaughtered un der inspection or farmers must get their own facilities approv ed so the animals can be slaugh tered under inspection at the farm. Since most farmers slaughter only small volumes of livestock, it will be impractical in most cases to apply for approval of small farm slaughter facilities. If a farmer has his livestock slaughteied at a plant under inspection, he is then free to re tail his meat cuts and farm pro cessed meats. As a small retail er, the farmer does not need a meat handlers license. As a retailer, however, he is subject to the laws and regula tions of the Pennsylvania De partment of Foods and Chemis try. A farmer’s meat offered for sale at a retail outlet will be subject to the same random sampling of product which rep resentatives of this department apply to retail food outlets throughout the state. Therefore, the producer re tailer is prohibited from having excess levels of moisture, fat, extenders,, chemical pieserva tives and coloring in the meat products which he offers for retail sale. Some of these regu lations are currently being re vised. If a farmer plans to expand his business beyond retailing to meat wholesaling, he is then re quired to apply for a meat handlers license.
