SECTION 1-103. ISSUANCE OP PERMIT. Upon being satisfied that the application is in proper form and that the proposed work may lawfully be done and that the plans jnd speci fications are adequate for the protec tion of the roads and safety of per sons and property, and upon receipt of the permit fee, and full compliance by the applicant with all other appli cable requirements, the permit officer shall issue a permit If he deems It reasonably necessary for the protec tion of the roads and the safety of persons and property, he may attach special conditions to the permit, and may limit the time within which the work must be done ARTICLE 2 General Regulations, Provisions and Specifications , ~ , SECTION 2-101 The work authoriz ed by the permit shall be done at such time and in such a manner as shall be consistent with the safety of the public and shall conform to all requirements and standards of the permittee herein specified If at any time it shall be found by the per mittee that the work is not being done or has not been properly per formed, the permittee upon being notified by permittee, in writing, shall immediately take the necessary steps, at its own expense, toward placing the work in condition to conform to said requirements or standards. SECTION 2-102. In the event of wil ful failure or neglect by the said per mittee or its employees to perform and comply with the conditions, re strictions and regulations, the per mitter may revoke and annul the per mit and order and direct said per mittee to remove any and all struc tures or property belonging to said permittee and covered by this per mit from the legal limits of the high way SECTION 2-103 Unless the per mit shall provide for restoration of the road surface by the permittee, all such resurfacing work shall be done by the township, and the cost thereof shall be paid by the permit tee The permittee, however, shall be responsible in all cases for the filling and maintaining of the trench until the suifacing is done, and for full restoration of all shoulders and -other parts of the road outside the paved portion Upon completion of the w’ork and filling of the trench, the permittee shall notify the township secretary m writing, and, (unless the permit requires the permittee to do the resurfacing), when m the opinion of the Supervisors the resurfacing may properly be done, the township will do the work. If the peimittee, after making an opening in the "high way to place or repair pipe or for any other purpose, Tails to restore the roadway including paved surface, (except to the extent herein otherwise provided), shoulders and ditches to their original condition, the township may do the work, "and bill the per mittee for the cost of the restate'’-: SECTON 2-104- All work done under this permit shall be subject to such conditions, restrictions, and regulations as may be herein prescrib ed and required by the permitter SECTION 2-105 The permittee shall use diligence in the execution of the work authorized under this permit in order not to obstruct unnecessarily or endanger travel along the said high ways Operation must be conducted at all times to permit safe and reason able free travel over the roads within the limits of the work herein prescrib ed All safety provisions for the free movement of traffic shall be provided by the permittee. Access to the high way from entrance of any private or side road or any driveway shall not be obstructed except during such necessary period when work is actual ly in progress at such entrance Safe bridges shall be provided at each such entrance where a trench Is to remain open for more than twelve hours SECTION 2-106 Red lights shall be displayed from sunset to sunrise at any and all points of the work where there may be danger to any person lawfully using the highway. SECTION 2-107 In case dynamite or other explosive Is used on the work, all possible precautions shall be observed to prevent loss of injury to persons or property. SECTION 2-108. The permission granted by the permit does not re lieve the permittee from obtaining any consent otherwise required from the owner or owners of the abutting property nor does not confer upon the permittee the right to cut, remove or destroy trees or shrubbery within the legal limits of the highway except under such conditions, restrictions and regulations as the township may prescribed in any specific case, or generally If any trees are removed within the limits of the highway by the consent of the property owner, the stumps must be cut to the ground level, or removed entirely, if required by the permitter SECTION 2-109 Excavation or other material shall be placed or stored on the side of the operation farthest from the road metal or pave ment, unless otherwise authorized by the permitter, and in such a manner that there will be no interference with the flow of water in any gutter, drain, pipe, culvert, ditch or waterway SECTION 2-110 All excess excavat ed material shall be removed and dis posed of outside the legal limits of the highway as the work progresses, unless the approval of the permitter is obtained for disposal of the ma terial within the legal limits of the highway All parts of the highway and various structures disturbed shall be restored to a condition equal to that which existed before starting the work Guard rails shall be replaced to the present alignment, and any guard post discolored through the work of the permittee shall be re fimshed by washing or repainting SECTION 2-1 U If at any time the structure or facility shall fall from any cause whatsoever the permittee shall have the same removed or re paired within 48 hours after receipt of written notification, except at times of extraordinary happenings when extension of such time may be given by the permittee SECTION 2-112 Except as herein above provided for resurfacing by the township, after each and every exca vation made by the permittee in any road or highway covered by tins per mit incident to the erection, repair, re setting or removal of any poles, man holes, conduits,-water, steam, oil, gas pipes, sewers or any other obstruc tions or construction, said permittee shall under the supervision and direc tion of the permitter, restore such road to as good condition as existed prior to such excavation unless other wise herein provided. So long as said LEGAL NOTICE permittee operates and leaves in place such structures and appliances, -in, upon, or along said highway, the per mittee shall maintain and keep in good order and repair the said struc tures and appliances. The permittee covenants and agrees to fully indem nify and save harmless West Lampeter Township and all persons lawfully on the kaid road and all owners and oc cupiers of abutting property of and from all liability, loss or damage for damage or injury to persons or prop erty through or in consequence of any act or omission of any contractor, agent, servant, employee or person engaged or employed in, about or upon the said work, or in any way arising out of the performance of the said work, or from the failure of the permittee to- comply with the pro visions for maintenance as set forth in these regulations. SECTION 2-113. If any time In the future the highway is widened, re located or the alignment or grades changed the permittee further agrees to the extent now or hereafter re quired by statutory or common law, to change or relocate, at its own ex pense, any part of the structures cov ered by this permit which interferes with the improvement of the highway, to such location within the limits of the legal right of way of the highway as may be directed by the permitter or local authorities. SECTION 2-114. During the time when any road or highway covered by this permit is under proess of con struction, and/or until said road or highway is accepted by the permitter or local authorities, no permittee will be authorized to enter upon said road or highway for the purpose of erect ing poles, laying conduits, water, steam, oil or gas pipes or sewers, or doing any other work whatsoever which might interfere with the con struction of the road or highway, un less said permittee shall first file with the permitter or local authori ties a duly attested certificate signed by the contractor or other authority constructing said road or highway, which certificate shall contain full consent to such proposed operation of said permittee within the lines of the said road or highway, together with a satisfactory waiver, release, and quit-claim to the Commonwealth of Pennsylvania and the local authori ties, of all damages and all defenses whatsoever for delays by reason of such operation and occupation of said roadway by said permittee, or from any cause whatsoever resulting by reason of such operation and oc cupation, provided that the provisions of this paragraph shall not apply in case of emergency; in such case the permittee shall procure the written consent of the permitter to do such work as may be deemed necessary to correct the existing emergency con ditions SECTION 2-115 The conditions, re strictions, and regulations hereinbe fore cited shall also govern all ex ceptions, openings and trenches for the purpose of making repairs to any poles, conduits, water, steam, oil or gas pipes or or other structures, o" nn-_ cr,y and appurentances there to "belonging erected on or in the highway SECTION 2-116. After a permit is granted by the permitter it shall not be asssigned nor transferred without the written consent of the said per mitter. ARTICLE 3 Subsurface Operations SECTION 3-101 Trenches for con duits, water, steam, oil, gas pipes, and sewers and other obstructions placed parallel with the road or highway shall be dug so that the near edge of the trench is at least three feet out side of the edge of the road metal, unless the permitter shall authorize in writing a lesser clearance. A greater distance shall be used where prac ticable. SECTION 3-102 In case the road or highway is not improved the trench shall be placed so that its near edge is at least 15 feet (the distance shall be greater than the mmimum where practicable) from the general center lines of the traveled road or highway unless authorized as provided in the foregoing paragraph. The center line shall be determined by the permitter or local authorities. SECTION 3-103. The trench for such construction shall not be opened for a distance of more than 1,000 feet at any one time, unless especially au thorized by permitter. SECTION 3-104. Where a tile drain or other structure or facility is en countered, it shall be replaced or re stored by the permittee in accordance with the prevailing standards of the permitter —- SECTION 3-105 The backfilling of the trench shall follow as rapidly as possible the placing of subsurface structures and shall be completed in such a manner as will conform to the earth shoulder The trench shall he tamped as refilled, and no layer prior to tamping shall be greater than four Inches m thickness Approved mecha nical tampers shall be used exclusive ly for backfilling, unless other methods are approved by the ter. SECTION 3-106 All parts of the shoulder disturbed or damaged in the performance of the work shall be reconstructed and restored m as firm, strong, and durable condition as be fore the commencement of work by the permittee, in accordance with the standards of the permitter. SECTION 3-107. The permittee shall place the top of manholes to conform to the elevation and slope of the shoulder, unless a lower eleva tion shall be approved. SECTION 3-108 The permittee shall restore the ground surface with in the limits of the work covered by the permit to a condition equal to that existing prior to the opening of the trench, unless otherwise provided in the permit, and shall maintain it in such condition for a period of 12 months after completion of the work and shall be released only after satis factory report by the engineer acting for the permitter, except where work of a similar character shall be done during said 12 month period within or adjacent to the limits of the work covered by this permit or affecting the same, by another permittee, pur suant to a permit duly Issued by the permittee SECTION 3-109 In ease it is neces sary to cross under any improved road or highway, the opening for a pipe line shall be drilled, bored, or driven at a minimum depth of three feet be low the surface of the road or high way, or the structure may be placed by tunneling when approved by the permitter. Trenching will-be authoriz ed by the permitter, in writing, where tunneling would be attended with danger to life. Where necessary to cross the improved road or highway by tunneling, the crossing shall be made, except in solid rock formation. LEGAL NOTICE under one-half of the Improved road width, and the pipe pr structure plac ed and the hole carefully backfilled with 13 6 concrete of a dry consis tency thoroughly tamped, and allow ed to stand 24 hours before traffic is -permitted to use that halt of the road The second half of the tunneling is to be completed in the same manner, so at least one-way traffic will be maintained over one-half of the Im proved road or highway while the sec ond half is being tunneled In solid rock formation the crossing may be made by trenching when approved by the engineer representing the permlt ter, but not more than one-half of the width of the pavement shall be opened, the structure placed, the trench backfilled and tamped with an approved mechanical tamper, unless other methods are approved, before disturbing the remaining one-half of the road . , , SECTION 3-110. Openings made for the purpose of placing pipe lines or other structures under the Improved surface by drilling, boring, driving, or tunneling, shall be made at least three feet from the edge of the road metal, unless the permitter shall oth erwise designate in writing. SECTION 3-111. If an Improved township road is to be opened and by terms of the permit the permittee is to restore the surface, the method of repaving is subject to approval and Inspection of the Board of Supervi sors or their authorized agent SECTION 3-112 Warning signs shall be placed 300 feet or more be yond each end of the actual operation,- and special employees shall be as signed by the permittee to direct traffic when it becomes necessary to limit it to one way Advance permis sion must be obtained from permitter, or authorized agents before directing traffic through one lane. Substantial barricades shall be provided and main tained between the road and any open trench or hole when in the judgment of the representative of the permitter it is necessary for the proper protec tion of the traveling public ARTICLE 4 Surface or Overhead Operations SECTION 4-101. All poles shall be placed on the outside of the ditch or gutter lines, and in all cases a clear space greater than the width of the berm or shoulder must be preserved between the near face of the poles and the edge of the improved 'or traveled road or highway, unless the permitter shall otherwise authorize In writing. No poles or other overhead structures shall be placed where they will obstruct the view of traffic on the highway, nor within five (5) feet of anv warning or direction sign, un less specifically permitted in writing. Such poles on Township highways aft er being erected shall be painted white by the permittee at its own ex pense for a height of at least six (6) feet above the ground, when, so re quired by the permitter. SECTION 4-102.A1l wires, except power transmission and supply lines, appurtenances or supports attached to poles which cross the highway shall be placed or erected so as to provide a minimum vertical clearance of fif teen (15) feet for a distance of four teen (14) feet on both sides of the highway center line. Where power transmission and supply lines cross over a highway in urban and rural areas, vertical clearance and other requirements of the National Electri cal Safety Code must be complied with All guys shall be placed so as to avoid interference with traffic of all kinds on the highway, and must present a neat appearance when in stalled, if for electric light or power lines they must be adequately insulat ed at a point not less than ten (10) feet vertical above the ground) If for telephone lines when in proximity to electric light or power lines they must be adequately Insulated at a point not less than eight (8) feet vertical above the ground. Exception When guys are per manently grounded in conformity with accepted grounding practice, in sulators may be omitted Provided, however, that permittee must state in application for permit the method whereby such guys, when installed, will be properly grounded, and must, thereafter, maintain the same, through periodic inspection of all ground connections This exception applies primarily to guys exposed to circuits carrying more than 14,000 volts and to guys uniformly perman ently grounded throughout in connec tion with any grounded supply circuits using continuous ground wire. SECTION 4-103 All poles installed on the right of way of a Township Road which requires marking shall be equipped at the time of installa tion, with three (3) size (A) crystal colorless reflector buttons, mounted in a vertical row, spaced six (6) inches apart, six (6) feet above the grade of the crown of the road The row of buttons shall face approaching traffic, forming an axis of five (5) degree angle toward the roadway, as indicat ed by Department of Highways Stand ard G-26. When present pole markings are in need of replacement or repaint ing, the reflectors buttons shall be in stalled on those poles, in conformity with said Standard. SECTION 4-104 All poles that may be erected shall be numbered, ana said number together with the initials of the permittee shall be plainly desgi nated thereon by and at the expense of said permittee. ARTICLE S SECTION 5-101 All permits shall be subject to the terms and conditions of regulations applicable thereto which the Board of Supervisors shall from time to time adopt. ARTICLE 6 SECTION 6-101. Any person, firm or corporation who shall violate the terms of this ordinance or of any of the terras and conditions of any per mit issued hereunder, including the regulations applicable thereto, shall, upon conviction, be sentenced to pay a fine or not less than $25 00 nor more than $3OO 00, and in default of pay ments shall be sentenced to imprison ment in the Lancaster County Jail for not less than five nor more than thirty days ARTICLE 7 SECTION 7-XOl Any opening of the surface or the installation of any structures or facilities in any road in violation of this ordinance or of the terms of any permit nr the regula tions shall be deemed a nuisance, and in addition to any other available remedies or proceedings, the Board of Supervisors may take any appropriate action, or institute any appropriate proceeding to abate or enjoin such nuisance Leßoy K.
