Jeffrey A. Lencki, 21, was a passenger in a vehicle driven on Belle Road by 24-year-old Frank R. Stewart, of North East. About 11:47 p.m., Stewart lost control of a 1989 Honda Prelude while traveling east bound about three-fourths of a mile east of Davison Road. Police said Stewart was driv ing too fast for road conditions. MULCREEK Millcreek Township Police have charged a 21-year-old man with being in possession of a stolen gun and drug para phernalia. Police arrested Justin J. Beers Monday night after in vestigators searched his home in the 3300 block of West 12th Street. Police also recovered what investigators believe is heroin. The substance is being tested. Police charged Beers with possessing stolen property and possession of drug parapherna lia. Police are working to trace the owner of the gun, investiga tors said. WARREN A fire marshal is investigat ing an overnight blaze in War ren's second fire this week. Crews responded to a fire at a vacant two-story building at 9 Buchanan St. about 3:14 a.m. Warren Fire Department Captain Dave Krogler said the fire started in the rear of the building before spreading to the roof and attic. CORRY A set of triplet boys at the center of a landmark local cus tody dispute will turn 6 years old in November. A suit over the handling of their birth, to a surrogate mother living in Corry, is likely to go to trial in Erie County Court in early 2010. Ajudge has refused a request from the defendant, Hamot Medical Center, to dismiss the case, whose plaintiffs are the triplets' biological father and his fiancee, both from a Cleve land suburb. Judge Ernest J. DiSantis Jr. rejected Hamot's arguments that the plaintiffs filed the suit too late. He said the statute of limitations for filing the suit hinged on the date of the final custody order for the children rather than the date of their births.
