See. 8 requires the stockholders ko give mortgages on property [real estate] equal in amount to the stock subscribed. • Sec. 11 requires the stockholders to pay ten dollars on each share of stock. Sec. 12 requires that at least five hon. dred thousand dollars shall have been sub scribed and paid in, before the Bank shall go into operation. Sec. 29 rerrines that thu hoods, as well as the mortgages of the stockholders, shall be deposited in the office of the bank. Sec. 30 requires the Governor to ei L e. cute the bonds of the State, in amount pro portioned to the sums subscribed and se,4 cured, as required by the charter. These were the terms published ; and the advocates of the bank contended that the State could not possibly sustain anv loss, for the terms of the charter required triple aectirity—lst. The mortgages ere, real estate; 2d. The bonds of the Stock— holders; 3d. The capital of the bank.-- Under these circumstances, the election was held; on the first I\lcnday in January, 1838, the Legislature convened, and rais ed a joint select committee on the - Union Bank, and instructed that committee to inquire what amendments, if any, could be made in accordance with the constitu— tion. After several days of deliberation, that committee reported that 'The bonds and mortgages of the stockholders consti. tote the vital principle upon which' the aith of the State is to be pledzed; and, as vich, it cannot be altered without agairt'' submitting it to the people for their sanetion,' ti", c ; which report was received an agreed to in both branches of the Legisla- - ture. At page 187 (House Journal) the origi nal charter was passed a second time— yeas 52; 35 Whi gs a n d 17 Democrats. This is stated front memory, but I believe it to be correct. The charter was alrso passed in th e Senate, and became a consti tutional law. But the Union Bank bonds were not framed and sold under this law; for at the thew that these bonds were exe cuted and sold, not a single requirement of the charter was complied with; not a single share of stock was taken, nor one dollar paid in, nor bonds and mortgagee taken or deposited as is required by the charter. The bonds purporting to be the bonds of the State of Mississippi, which were sold to Nicholas Biddle (not one dol lar of which has ever been received by the State) were framed under an act passed near the close of the session, entitled "Au acts upplementary to an act tr. incorporate the subscribers to the 'Mississippi Unio'a Ba sk;" which law was never subrnittei th e trr ,subpeople, u is required by the constitu. , but which the Legislature - mit. SIR: axing the short stay which t made in the city of Richmond, I discover; ed much anxiety evinced by a few mem% berg of your Legislature, with whom I bad intercourse, to understand the grounds up* on which the miscalled Mississippi repudit anon is founded. My situation dtd not jtben, nor does it now, permit me to do ustice to the subject, yet I will give a brief expose of the most important facts Which are at this time within my reach—not doubting that ail inquirers after truth wil t do justice in the premises, 1 will assume, first, that the Stae of Mississippi is a Rove' flout of constituttion and laws. 2d. That the constitution was adopted solely for the purpose of securing the rights and liberties of the people, and is as potent a limit upon the action of the State Government as the Constitution of _ the United States is, or should be, upou 1 that of the Federal Government. 3d. That every officer and agent is required 'to take an oath to preserve the constitutiou inviolate; and 4tbly. That the highest du- ty of every citizen is (as a security of his rights) to exact from all officers and agents a BPI upulous observance of all the require ments of the constitution. The people of Mississippi, .a few years since, remodelled their constitution.
