He has but recently been released from Sing Sing Prison', where he has served out a term of five years. He is said to be con nected with one of the first families of Virginia, from the vicinity of Richmond His principal foite has been in the robber ies of banks, and' in this he has been quite successful. Hal is said to be an expert gambler. capable of winning or losing tens of thousands of idollars per night. His operations have .been carried on chiefly in New York, and other cities. Messrs. Shalefand Hamilton appeared in support of the rule and Messrs. White and Veech for the city. The ground taken by the, latter was that the Treasurer is not guilty of contempt, be being "merely the custodian of city funds, without power to raise or appropri ate revenue and only empowered to pay money on warrants signed by the Mayor and countersigned by the controller. No warrant everlhaving been presented to him, he has never refused to pay, and is conse quently not in contempt. 'The mandatory writs could only. properly issue against the City Councils, they beingthe only muni cipal powerwho can raise and appropriate revenue. At the close of the argument, Judge Grier said . a decision would be given in these cases neat January, prior to the time when the City Councils are required by law to make the annual appropriations. Postponement of the Proposed National Conxention. The following official announcement is made of the postponement of the pro posed Natiotal Convention, fixed for Tuesday next: A large number of the signers to the call for a National Convention to be held in this city on the 25th of November, 1862, convened at the "Uirard House," on Wed nesday evening, . the 19th inst., for the purpose of copsultation in reference to the propriety of holding said Convention at the time designated. John Harper, Esq., was called to the Chair, and F. E. Volz appointed Secretary. After consid erable debate, in which Joel F. Keeler, ex-Gov. Johnston, James McAuley, J. M. Roberts and others participated, it was, on motion of J. F. Keeler, Resolved, That the time for holding the National Convention in this city, in sup port of the Government, for crushing eat rebellion, terminating the war and pun ishing traitors, be postponed until the Bth day of January, 1853, when it w positively be held. On motion adjourned. Jinn; HARPER, Chairman Fuzn. E. Voi.z, Secretary. Arrest of Thieves. Yesterday the Mayor's police succeeded in arresting three parties who .committed the robbery at D. S. Diffenbacher's shoe store, Fifth street, '.on Sunday night.— Their names are Rufus Connor, Michael Tanner and James Tart, the latter a wiry old °fender. Several pairs of the stolen shoes were found, on Wednesday, in pos session of some females residing in Alle gheny City, and yesterday, after the arrest the house occupied by the' women was searched and the remainder of the goods found. The women were held as witnesses and their testimony will convict the ac cused. There have also been other arrests of parties suspected of having been engaged in thieving operations—the total number in two days past being eleven. Of . these, two are accused of having been concerned in the r‘ cent robbery at McClellan's auc tion store. Horses Sent East. All the horses in the cavalry camps near this city have been ordered East for Gen. I3urnside's army, and the greater part of them some 850 have already been sent forward. Benefit of Mr. Eddy. Mr. Eddy makes his last appearance this evening, on the occasion of his ben efit, for which a'strong bill is offered, em bracing the "Gladiator," Mr. Eddy as Lydon, the "Game Cock of the Wilder ness," Mr. Eddy as Samson Hardhead, and the farce of "Slasher and Crasher." Mr. Eddy is an actor of great merit and deserves a bumper to-night. Let all who admire his personations be in attendance. Successful Expedition. An officer of Gen. Milroy's brigade, who reached Wheeling on Tuesday, states that on Tuesday of last week, Gen. Milroy and Col. Latham,liaving started with a con siderable force from Beverly, a few days previous, attacked and surprised a camp of rebels at Crab Bottom, in Highland county, not far from Monterey, capturing about three hundred fine cattle, about one hundred horses, and taking.over a hundred prisoners. The rebels, about one hundred in number, were guarding the stock in the bottom, and were completely surrounded before they were aware of it. The ex pedition returned to Beverly on Saturday last. Defeetive Indictment. A none pros. was entered yesterday, in the Court of Quarter Sessions, in a case of nuisance against the Pittsburgh and Cleveland Railroad Company for obstruct ing the highway, by laying their track in the borough of Manchester. The indict ment was defective, having been drawn against the Company, instead oF against the Receiver, in whose hands the road is. Plead Guilty. Emma Black, of Third street, yesterday plead guilty, by her counsel, T. B. Ham ilton, Esq., of keeping a bawdy house. Sentence was deferred, and it is said that Emma is now absent from the city and will not voluntarily appear. Her bail will, therefore, be obliged to stiffer. Heenan•s Companions: The cases of the alleged accomplices of Thomas 13. Keenan, convicted of murder last week, viz : Hoerr, Balty and. Kierch artz, indicted for aiding and abgtting in the murder of John A. Obey, will' be call ed up on Monday. Committed Suicide. A man named Richard Sproats, resid ing near Washington, Pa., committed sui cide on Wednesday morning by hanging himself in the mow' of a stable on his father's farm. The only apparent cause for the rash act was in his having sold his wain and some cattle at too low a figure. He was a single man between thirty-five and forty years of age.
