A short time previous to retiring Irom the posU tion whioh be disgraced, that keen financier •old to a locomotive machine shop in New Jersey nearly two dozen very large guns, averaging 7,000 pounds each, at the nominal j price of $2O per ton. The guns were sold as oUHron, though worth at least fifty cents per pound. When taken to the machine shop the attempt was made to break them in the ordin ary manner, but it was found to be a physical impossibility. Finally they were put in a lathe, and in that way wrenched to pieces. Several of them are yet unbroken, and the de partment will probably repurchase them. Thi newspaper correspondents, in and about Washington city, appear likely to get into trouble, on account of their anxiety to furnish the daily press with news in reference to the •rmy, in advance. One officer, it is said, has ordered the shooting of all reporters found within the lines. Doubtless this trouble has been caused by the sensation reports of the New York dallies, and steps should be taken promptly to ascertain who are gailty of viola tions of confidence, and who are innocent. It is not right that a whole class of very useful and Intelligent men should suffer any indigni. ty or harsh treatment on account of the in discretions or criminality of two or three per sons. The plaintiff in thi- case is ono of tho credi tors who did not assent to tho exlensiou, and opposes such reference and order as a violation both of the Constitution of the United States, and of the Commonwealth of Pennsylvania. The ground that the Judge takes is that it contravenes the Constitution with regard to tho law of contracts and is of expost facto, nature and practically takes away or denies the right to remedies for broach of contracts, and is an uncon&tiatioo&l interference with the jurisdic tion of Courts of law. Prom the opinion of the Judge we extract what we believe is tho salient point “Two thirds iu value and a majority in number * f the creditors decide what is reason able, and the act gives the Court no power to review their action. Tho slay ordered to be entered by the Court, must be in precise con formity to that reported as the terms of the agreement of the creditors. Wo cannot tay that the act i* constitutional as to such agree ment! as we deem reasonable, and unconstitu tional as to such as we think unreasonable.— Such a matter cannot be the subject of judicial discretion. Wo have no power to do what tho ■Legislature bn.« not dune—annex a proviso that the stay shall not exceed a certain limit If it be true that the -Legisisturo may grant a reasonable stay, it is not reasonable to leave it to the decision of a majority in number and two-thirds in value of the creditors—a tribu nal not recognised by law, and which may be ouduly influenced in favor of the debtor. It must be competent lor the plaintiff in each case, to deny the bona jide of the assenting creditors; yet no provision is made by the law for the decisioe of the question, unless it be by the prolhonofary, and no power of revi sion is given to the Court over his determina tion. On the wh< !e, we are of the opinion that this provision of the stay law is so dearly and palpably unconstitutional, that we ought not to refer the base bofore us to the prothono tary.” THE CAPTURED PRIVATEERS. There are many difficult questions to be decided by the Government,which are daily •rising out of this war. The capture of the Southern privateer, .Savannah,with her crew of twenty-four men devolves a very delicate, as Weil as a very grave, responsibility ujk>ii the executive aud judicial authorities ol the United States, which be promptly and properly discharged. The President has solemnly denounced the Confederate priva teers to the world as pirates. We shall now whether the Government can and will | this poaitiou. The question is a grave one, and should be calmly and fairly tried in the courts ot law. The chief of the crew of privateers which has been captured is a Philadelphian. There are other* who are not Southerners, and who have been instigated in their action more by a desire for gain than by any political feeling. A precedent must now bo established which Bhall rule in similar cases while this war lasts. The First Massachusetts Regiment, 1,046 strong, passed through Jersey City on Saturday en route for Washington.
