Isaac Scott, in dicted for assault and battery with intent to kill, 'on oath of Wm. Smith, was resumed. Thos. M. :Marshall, 'Esq., addressed the fury fur the defense, and John IL Bampton, for the prosecution:_ The jury retired, and found a verdict of guilty of assault and bat _ tery. The Court imposed a_ tine of tea dollars and costs. Commonwealth vs. John Ward, charged with assault. ,and battery, on oath of .Jacob Poth, Street COmMissioner of the borough of Birmingham. Prosecutor had been ,instret ed hy the borough council to !owl the wharf by placing cinders upon it; while so doing he was seized ' by defendant, who endeavored: to prevent the bands front doing their work. The assault occurred on the ith of May, near Ai'Knight's rolling mill, and originated in a dispute as to the title - to the property, it being claimed as public property by the borough, and as private property by Mr. Christian Ihmsen, who had given Mr. Pcth notice, through ,an agent, to desist from placing cinders on that part of the wharf. The title to the property and the slight injury done to prosecutor, .we_s the defense. The jury had .returned no ver dict at adjournment. Charles T. Ihmsen, in a suit growing Mit of the same circumstances, pleaded guilty to a charge of assault and battery, preferrek by John Speller, and was fined five dollars sand the costs of prosecution. Joe Dawson pleaded guilty on two indict menti for the larceny of clothing from Her wig's hotel, and was sentenced to live months' imprisonment on each. - 'William Barclay eras indicted for i ssnult and battery on Wfbarn Sproull, a night watchman.
