It Reresen— The proceedings before Judge Hampton, on Fri• day, were opened by Mr. Rippey for the railway company, by reading the decree of the Court of Quarter Sessions, granting under certain restric tions the right of way to the Cemetery gate' lie claimed that the said adjudication is final and conclusive, and that the railway company have in all respects conformed to the orders of the court; that a large amount of money - has been expended and labor beelowed on that portion of the road between the Arsenal and the Cemetery, and that the plank road company have been all along cognizant of these fasts. The respondents also aver that if damage has been done to the plank road company, application should have been Made to the Court of Quarter Seesioen of this county; that the act of Assembly has con: . , furred Die exclusive juriediction over the road in question upon the Quarter Sessions. It was also contended that no court ought to interfere by itt • junction in any matter which has been already adjudicated. It appeared that the regularly constituted authorities of the plank rood company did not appear in court at all, hut that the injunction" was asked for by one of the stockholders, Mr. Thomas Rea; that the President of the Board of Directors is absent, and that the Directors neg• led or refuse to meet and promote measures for the defence of the rights of the plank road cam. pany. Mr. Hamilton, for the said company, therefore moved as an amendment to his bill* or complaint that the plank road company be mail,' a co-defendant with rho passenger railway com pany. Thus the Iwo companies would stand as defendants, with Thomas Rea as complainant or plaintiff.. The counsel alleged that the plank road company was.withont a hood Mr. Rippey contended that the admission of complainant is fatal to the whole proceedings is court, for he admits that the constituted author. ities of the plunk road company are not here aching an injunction nr anything else. He ar gued that the absence of the President of the corporation was of no moment ; that by the art of Assembly : of 1349 the management and aflaire of turnpike and plink road companies is com. milted to a President and five Managers, scot of the latter a majority were now almost within the hearing of his voice. The plaintiff was in court alleging and acknowledging a state or films that would turn hint out of 'court. lodge Hampton said that leaving out of view the question of forfeiture of franchises, and ad mitting the amendment asked for to make the Plank Road Company a co - defendant with the Railway Company, he did not see any good ground for granting the injunction asked for The respondents allege that the road will ' , extl is made better and more valuable to the Plank Road Company, by the repaire and rebuilding of the road, than it has ever been. It Lae been kuown to the Plank Road Company ever since June that the Railway Company intended to use the road, and Lad obtained the right of way to the Cemetery gale, and had not during the whole lime taken any meaeures to slop the pro. geese of the company in laying their rail, and even now the Plant Road company itself does not appear in Court. At this point, Mr. Hamilton awed to the Court that he desired to argue the merits of the I case. Ile alleged and produced affidavits to show that a trespass hod been eommittel on the righter and franchisee of the Plank Road Com pany. Th e Railway Company comes into Court here, alleges that the Plank Road has not been t kept in goal repair and thus, bring a sort of waif, may be seized upon by any greedy adieu tures that may happen along. Mr. Ittppey amt Mr. Verner appear here in a judicial character, peas upon the question of the rights and (ren al:glare of the Plank Road Company, take posses eon of them and go forward to lay another road upon the bed of the Plank Read Company. The Act of Assembly grants the right to use the road only on condition that it shall pay for that right in accordance with at decree of the Conn of Quarter &anions. Mr. Hamilton took up the answer of twee d/rat, point by point, and spoke et length upon it. The Judge interrupted the counsel for plaintiff LO ask if some irreparable injury must not Le shown in order to authorize the granting of an injunction Mr. Hamilton anented, but claimed that a chancellor had no right to ash the amount or the nature of tlamagee. It is a question of tree pass. It will not do to ray that a corporation shell enter my house, lake possession of it, and tear it to pieces, meeting my objections to their proceedings by the answer that they will make it better by and by; that the damages they are letlieting aro not irreparable. This Plank Road Company may Lo small affair, but in the quite lion raised by it here, there are great interests involved. It is as if a railroad company should enter upon and take possession of property with out the consent of the owner and without any reparation or compensation for the damages that they would inflict. Mr. Hamilton concluded by expressing hie regret that the decision of the Court should have been intimated before he had made his argument. Ile had, however, the coo tie-Du:mesa of having done hie duly. When free persona of color aro removed from jail, the captain will be required to gire a bond of live hundred dollars that his vessel will leave within twenty.four hours, and that these free persons I of color will not be permitted to go on shore in the meantime. Dr. Potts' Church, corner of l'aiversity Place and Tenth street_ The body of the Church was well tilled by the friends and acquaintances of the deceased, and the services were very impressive. Shortly before the hour of ten, the intimate friends of the deceaSed assembled in the vestry, where ware placed the re mains of the deceased, in a beautiful coffin, of (it. Domingo Mahogany, lined with lead and covered with black cloth, and ornamented with plate. The procession passed into the Church, the organ playing a solemn dirge. The Rev. Dr. Potts, then ascended the desk and read an impressive psalm, after which be delivered a fooling and eloquent address, lib dis course was principally directed to the living in view of the solemn scene before them. lie referred to the many virtues of the deceased, and exhorted those present to profit by the example set forth by the life of the departed. The deceased had lived to the age of four score and three years, and he could bear tes timony that his end was peace.
