Kerr, better known, perhaps, as "Denton" Kerr, being foreman. While seated around the table in the room aforesaid, as we are informed by an oyo witness, Edward Campbell, Esq., Deputy Sheriff, came into the room, and at the request of a woman named Kelly, who had sumo matter of property pending before the jury, requested that they wuld act on that first and out of the regular or er. This was to give the party or 1:, soma of her witnesses an opportunity to leave for home, whit er it was alleged they were obliged to go as it on as might be. The foreman of the jury (K rr) answered that the matter should be taken up in its regular order. A list of the cases was lying upon the table, and Mr. Camp bell - reaching over to take it Kerr attempted to snatch it from him and •told Campbell he had better go about his business, or words to that effect, to which the latter responded that as to • that matter he would consult his own conveni ence. Kerr said he would not have a black ' guard talk to him in that way, and Baking a sand-box from the table hurled it at Campbell's head. It knocked off his hat., and glancing struck Mr. Quinn, ono of the jurymen, on the head, inflicting a Blight wound, Parties inter - fered hero to prevent further collision and Mr. "Campbell left the room. But a short time had elapsed before Campbell came back and the difficulty was renewed. He struck Kerra blow in the face, which the latter resented by 'drawing a claspAnife from his pock et, and, in spite of chair which Campbell caught to ward 01 the blow, inflicted a most horrible :gash on Campbell between the wrist and elbow in the thick and muscular part of the left arm. - Arteries and veins were severed, and the bleed spouted ,in streams about the court room. Campbell appeared to be the only cool man present, and seizing the wound&] arm just above the elbow with-his right hand, declared his ability to hold on till a physician should be procured. This was the work of a minute. Dr. M'Cook was brought, who proceeded at once to staunch and dress i i he wound, and in the course of an hour or so Mr. Campbell walked home, which is but a short distance from the court house. Kerr went out, whither we do not know. The Mayor visited the wounded man, but he re fused to make an information. As there have been no judicial proceedings in the matter, the above is hearsay, and if there are wrong state .menta they have j been made unintentionally. The case us above Stated is on the beat testimony we could procure., In the course of the melee, Kerr cut himself in the fleshy part where the thumb joins the right hand. The wound was a bad second bled profusely. —We heard, after writing the above, that the foreman of the jary dined at the St. Charles, with the rest of the jurors, immediately after the cutting affray, He did not, however, act with them again Lhis place having been filled on the jury by Col. J. H. Poster. 'P. S. Burtere::-It is saki that the case of Baptiste, the colored man who woe discharged from jail yes- Laden was a cue of oppression; that he was quiet and inoffensive, not having committed any unlawful act, nor was'he under any imputa tion when he was arrested; that he did not - know for what offence ho woe committed, and that his "dir•cooduct" was as worthy of that as of any other name. A. W. Foster, Esq., very promptly brought the matter befdre the Court yesterday morning and the Coast discharged Baptiste at once, as may be seen elsewhere. Cross-examined—Most of the tract, now lies ' in Penn tp; most of the Ross tract, at the time of survey, was in Collins tp; formerly it lay in Pitt tp; surveyed the James Ross tract previous to the don't remember of having sur veyed any other lot at that time. John Aber, sworn—Know John Rose, brother of defendant; know what part of tract John Ross occupied; James Ross' tract adjoined that of John, Joshua and Camp tract; Shade tract lay to the north; knew the parties to occupy the land for a long lime; knew the James Ross tract for upwards of 30 years; always understood James Ross to own the property known as the Ross tract; know the reputation of James Rose as a man of truth and veracity; always treated I me right. Cross-Examined—Camp farm I think comes in between John's and Jacob's tract. Dr. McClintock testified to the good character ' of the defendant. Mr. Hampton then offered a deposition of Sarah Dinsmore to show that she had heard Jane Henning acknowledge that she had no in terest whatever in the James Ross tract. Mr. Swartzwelder objected and the Court sustained the objection. [The counsel here having had a little sharp-shooting, the Court remarked that the weather was hot and the spirits etherial.— It would be well for gentlemen to try to keep cool.] Daniel 'Mel:lurk, sworn-;-Was present at the trial of action of ejectmcal; James Ross was witness there; ho was asked en role dire if he had any interest in the question at issue; said he did not know lint he had; Mr. Woods (at torney in that trial) asked him if there was not Isome agreement between him and Mr.-Kelly I with regard to that land purchased at Sheriff's 'sale; said he did not know hot there was an agreement of-this kind, that when he paid Mr. Kelly the principal and interest of the debt, that he should Obtain the land; didn't say whether it was verbal or written; Mr. Ross pro duced a draft of land (shown and identified:) ' exhibited it on his role dire to the Court; James Ross explained to Court the division of prop erty; no request was made on the trial for Mr. I Ross to produce-the article of agreement; have I known Mr. Ross (deft.) since 1821 and know I nothing against him. Objected to and ruled out. These offers were ruled out by the Court on the ground that the testimony was not rebutting, but be longed CO the examination in chief and should have been offered there. In the afternoon, the argument of Mr. Hamp ton was commenced at about two o'clock. Ile argued in the first place the question of law, that to exclude a witness he must have a cer tain, not a possible or contingent interest in the result of the suit in which he gives his teatime i-ry. Some other remarks and copious quota tions from the books were made as to the ques tion of the materiality of testimony. The argument to the jury occupied the Court until about four o'clock. It was a very able effort and fully sustained the reputation of Mr. Hamp ton as a successful pleader. It was past four o'clock when the defence con cluded, when Mr. Swartzwelder commenced for the prosecution. He spoke a little more than half an hour, audio a clear and succinct manner presented the law points to the Court with the authorities and summed op the Theta to the jury. When the learned gentleman had concluded, the Court adjourned for the day. The charge of the Court will be delivered this morning. I MOIL ,115,T. • Messrs. Edikes:—On Tuesday evening last I had the pleasure of attending a concert of vocal and instrumental music at the Western Pennsyl vania Hospital, given for tle benefit and amuse ment of the Inmates of the Insane department of that institution, being, I believe, the fourth en tertainment of the kind given there during the season. The audience was composed in part of over forty of the insane--male and female—whose attention, good order and apparent appreciation of the charms of music, really surprised me, and I wished that all the 'benevolent citizens of our community who have been so liberal In their contributions to this institution could have been present to enjoy the novel scene and feel thank ful that they had contributed in any way towards the comfort and amelioration of the condition of the unfortunate inmates. The musical performance on this occasion was not only creditable, but most excellent, espe cially In the vooaLdepartment, and as far as I could judge of its influence upon the insane spectators, I am convinced that a frequent repi tion of these concerts would be of immense benefit. There are now over ninety inmates in all de partme.nts, and almost daily applications for ad mission, which have to be refused for want of accommodation. Under thamost excellent management of Drs. Reed and Fuller, the institution is in an admir able condition, and I was very much pleased with the fitting up of the spacious female ward and two handsome parlors for their use, by car petings, furniture, a fine melodeon, flowers, shrubbery, and other fixtures for comfort and amusement, having been furnished by the contributions of many of our kind and phil anthropic citizens. I atu surprised so few of our citizens, corn• paratively, are aware of each an Institution in oar midst. Let them visit And examine for themselves.
