DRAYTON presented a memorial from Mer chants, desiring that the request of the Delaware avenue Company, in reference to the construction of an arch over Water street, in the Fifth ward, be granted. A communication was also received from Wm. IL Kern, log., asking Councils to set apart the old church in Crown street, above Race, for drill leg purposes for a company of ußeserves, ll which ho commands. Mr. WETHISHILL, a petition from property owners for the construction of a culvert in Seven- I teenth street, between Carpenter and Fitzwater. Mr NEAL, from the Committee on Water, re ported a resolution authorizing the Chief Engineer to contract with Masers. Jones& Cole f0r.3.000 tons of coal et $3 38 per ton, for the use of the Sohnyl- Ifill works, and alto tor 500 tons at 83 85 per ton ROM Gordon d Smith, for the Twenty-fourth Ward water works. Agreed to. The committee to verify the cash Recounts of the city treasury, submitted a report of the state of the treasury City fund $557.115 54 Trust fund 83,855 34 Mr. NEAL, as a member of the committee. stated that of the above amount there are $470.000 now in bank, for the payment of interest on then ty loan on the Ist of July. At that time, ho thought, no difficulty would be experienced, as all the inte rest would be promptly paid.l Mr. Davis offered a resolution continuing the salaries of city officials, who have volunteered their service', in defenee of the GeneMillent, until the 30th of April. Referred to the Committee on Fi nance. Mr. DICKSON presented a resolution instructing school directors to have one day set apart in the poblio schools for the insimation of the pupils in military discipline. Referred to the Committee on Sehoole. The bill authorizing the Delaware Market Com pany to oonstraot an arch over Water street was now called up, and gave rise to a prolonged debate. Mr. WIMISRILI, moved a proviso: "Provided the arch over the said street do not violate the will of Stephen Girard." Agreed to. The bill was finally agreed to. The following committee on the Fourth of July celebration was announoed : Messrs. McMakin, Magary, Ginned°, Riley, and Dickson Mr. Mitchsey submitted a resolution requesting the Mayor to tender the hospitalities of the oity to Lieut. Blemmer, of Port Plokena on his vantage to bie hems in Pennsylvania. Agreed to. Ad. Planed COMMON COUNCIL The president, Mr. Time, autmitted a commu nication from the Prothonotary of the Diorite Court, requesting . Councils to take some notion upon an application made to them some menthe since, in reference to enlarging the office of tnat department, and asking an appropriation for that purpose. Referred to Committee on City Pro perty. Mr Cassis presented a memorial from Lewis Fisher asking an appropriation of $233 25, to de fray the expenses of boarding and lodging oom• parry F, of Gen. Small's Brigade. Referred to Committee on Defence and Protection of the city. Mr. Bann called up the ordinance from Select Council making an appropriation to pay the polio. magistrates for the year 18G1. It was agreed to. Mr. !ilivaa submitted a report, signed by a ma jority of the committee, to make Penrose ferry bridge a free bridge, and asked that it should be printed for the use of members. The original coat of the bridge was $65,249 57. Referred back to Committee on Highways. Mr McCLEasiv offered a resolution instructing the clerks of Council to withhold their signatures from any warrants drawn in favor of Joseph R. Flanigen until be pays np all arrears. Mr HARPER thought there were personalities between the two gentlemen named, and considered that Councils had nothing to do with their diva greemaent. Mr. MoCiasenr replied that Flanigan was too contemptible for any man to meddle with. He was too small a mark for him. His ides.in offering the resolution was to have the city paid. Every other tenant bad paid his rent, and why should his be withhold? lie bad sympathy for a man who meets with misfortunes in his business, but Flaoi gen had the best printing of the city of Philadel phia. It was true he (the speaker) had been at tacked is the Daily News, but this did not in fluence him in presenting the resolution. The resolution was lost. Mr. Meander then presented a resolution di recting the clerk to give no more printing to the Daily News. On a motion to proceed to a second reading the yeas were 31, nays 32. A resolution was referred to the Committee on Railroads relative to regulating the right of way, Ao , on the Callowhill-street Passenger Railway. The bill providing for the loan of one million of dollars for the relief of the families of the volun teers was called np by Mr. Porraa and unani mously agreed to. Mr Reeves called up the ordinance, under dis cussion at a previous meeting. proposing to make an additional appropriation of $2,000 for the bene fit of Gen Small's brigade. Mr. Mateo moved to refer the bill to the Com mittee on Defence and Protection of the City. Not agreed to. Mr. Dlit.Len said he would like some one to give a season why this appropriation should be made to this regiment when no sash appropriation had been made to any other regiment of volunteers that has left Philadelphia. Dr. SITES said no other regiment had come into this Chambei and asked for an appropriation. If it bad, he would have advocated it most undoubt edly. Gen. Small had been the public servant of this body, and as molt was highly esteemed. He was the first in this city, when the Government made a mill for mon, to respond to that call. He worked night and day to get up a regiment for the defence of the country, and in a very short time enrolled his number. Having received despatches to proceed to Washington, he started, and was at tacked in Baltimore. The history of that event is well known Nothing daunted, however, he renewed his exertions. Other regiments were or ganized hare, and, through partiality, his was ex cluded. He persevered. and was finally accepted by the Government at Washington In the mean time he kept his men together, and large sums of money were required for their maintenance. The proposed appropriation is designed to defray the expense thus incurred. Dr. b. said Dia inte rest in this matter was so great, that if he were wealthy he would pay the cum out of his private purse. Re felt assured that Gen. Small's brigade would not tarnish the honor of the city when they came before the enemy. Mr. MiLien moved to amend that the farther sum of two thousand dollars be appropriated to the regiment of Colonel Mann, and two thousand dollars to each of the other regiments that have been organised in the airy of Philadelphia and Mustered into the service of the United States, and seven hundred dollars to the Independent Rangers Dr. SITES said he had no objections, provided - Mr. Miller would show that these regiments had been kept back in the same manner aa General Small's, and incurred the came kind of debta. behest Council now appeared, went into conven tion with the Common - branch, and elected the following : 'Port grardens.—Charles Harbert, George B. The amendment of Mr. Miller was lost—ayes 24, nays 36 Kr. itaarza, who opposed the ordinance at a previous meeting. said he had since had an oppor tunity of examining the despatches received by General Small from the Secretary of War, urging him to come on to Washington, although his men were not equipped or uniformed. Under then. circumstances he thought the appropriation should be made to defray the expenses incurred by the officers attached to General Small's brigade in keeping the soldiers together before they were mustered into service. A resolution from Select Council, tendering In dependence Hall to Lieut. Stemmer, for the recep tion of his friends, was concurred in. Mr Minima thought the passage of the ordi nance making an appropriation to Gen. Small's brigade would be calculated to produce insubordi nation among the soldiers. Ile hoped it would not be passed until the committee to whom the matter was referred reported. Mr FREEMAN moved to emend that the sum of $2.000 be taken out of the fund appropriated for the protection and defence of the city, for that purpose. Agreed to. The resolution from Select Council, with certain amendments relative to roofing the market•honse on Water street, was agreed to. A resolution censuring Charles M Neal, one of the City. Commissioners. on account of absence from his post, was received from the same Cham ber. Mr. Qum moved that the matter be referred to Committee on Law, with directions to make the necessary izquiries, and report to Cannons. Ti e thought Mr Neal should not be condemned with out a fair hearing. Mr. Kana said it was a notorious fact that Mr. Neal had been very often at Harrisburg and Wash ington for several days at a time, and referred to certain statements in regard to his Rations. The President stated that the resolution took cognizance merely of the fact that Mr. Neal was not in his seat, attending to his duties as City Com missioner. Mr. MULES said we knew that clerks for several departments were absent serving their country, and it was fair for Councils to presume that Mr. Neal was doing the same thing. trusted no committee of Councils would be appointed to pry into his movements. The motion to rarer was not agreed to. The second resolution, which virtually refers the matter to the Committee on Law, was agreed to. The resolution from Salon Council relative to maturing a programme for the proper celebration of the coming Fourth of July was concurred in. A resolution authorizing the contract made for a supply of coal for the waterworks, was passed as it oame from Select Council. Select Council refused to conenr in the amended resolution directing that Joseph R. Flanigan pay up arrears on hip rent, or remove from the build ing occupied by hint on Third street. Mr. Mitt= moved that Common Counoll recede from their amendment. Not agreed to. The matter will be referred to a committee of conferenoe: Adjourned. Brigadier General Pierce presided, and Adjutant General Schouler noted as judge advocate. It appeared in evidence that Abbott had made use of such expressions as those: would like to see rbe, Secession Sag wave over all the New England States. Abbott denied all the charges, but the court ' adjudged him guilty, and he was sentenced to be stripped of bin uniform and drummed out of the garrison.
