L. Lawson as for Allegheny county vs. Ohio and PensyWania Railroad. Goo. P. Hamilton and T B. Hamilton appeared for plaintiff; Thomas Williams, W. 8. Courtucy and John 11. Hampton for the defendants. This is one of the celebrated small note prose cutions, which excited so much attention some months since. Onr readers will recollect that the proseoutors in the oaso were tried for con spiracy, and on that ebargo couvioted and im prisoned in the county jail. The suit is based on an act of Assembly which inflicts a penalty of $5OO on auy corporation passing bank notes of a lesß denomination than $5, unless of the relief issue of this State. The proseoutors ac cuse the Railroad Company of passing sixty-one notes of a lesß domination than the aot pre- Kon ml the finßa for will amount to $30,- 000. The notes were passed in November, 1853, antj the suits, from various causes, have been delayed since that time. Considerable time was occupied iu empanel ■J«B a i ur y, which waa finally composed of the following gentlemen : 1. John Bridges, 7. Wm. Lyons, 2 Thomas Neely, 8. David Wilson, 3. Geo. Vought, 9. John Myers, 4. William Sorbey 10. Elijah Beam, 6. John Espy, 11. Joseph Swinloy, 6. Wm. Woolslayer, 12. Wm. Davis. The defendants, through Mr. Williams, put in n plea that they did Dot issuo the notes. Mr. George P. Hamilton opened the case for the plaintiffs by slating that, this was an action against the Ohio snd Pennsylvania Railroad Company for violating an important and highly beneficial Act of the Assembly, passed in ISSO Ihe jury had nothing to do with the policy of Ch V? 1 \.t bt 7 „ are 'o the mere enquiry Whether the defendants violated the statnte. The object or tho statnte was to decrease the pacer oiroulation of tho Commonwealth, a rolicy pur sued by the State for half a century. In carry ing out this objeot, tho meßt strenuous opposition has peen mot with from the great corporations of the Commonwealth That the Ohio and Penn sylvania Railroad Company hnve repeatedly vio lated this law, I have no doubt, and bow they are to escape from the penalty I am at a loss to concoive. Wo will show, by evidence which we will produce, that they issued sixty one notes and that they habitually disregard the laws of the Commonwealth in this respect. Exclusive privileges bavo been conferred on those corpora tions, and it was duo to every citizen that they should bo hold in close subjection to tho laws The law authorizes them to invado your farms teardown your houses, ami it is right they should bo held to a strict accountability. B Hamilton here offered to'rcad in evidence tho deposition of Absalom Morris, taken before Alderman Bteel This was objected to by Mr. Williams, on ac connt of the incompetency of tho witness. He stated that they had in Court the record of the convictiou of the witness for conspiracy ; a con spiracy to induce different banks and brokers of the city to violate the statute and extort money and to defraud Allegheny county on* of her revenue. On this account, the counsel contend ed the deposition was inadmissible. In support of this position he referred to a number of au thorities. Mr. G. P. Hamilton said that the prosecution for conspiracy had been brought against the plaintiffs for tho purpose of disqualifying them from testimony in this case ; but the offence was not of eocu a character even in case of convie tion, &9 to debar them from testifying. Mr. Hamilton argued this position at some leasth in & favorable manner. ~ ’ Judges Hampton and Williams considered tho matter for some time, but at last came to tho conclusion that tho deposition of Morris conld not be admitted, as he bad undoubtedly been convicted of an offence against the laws, Tho Court then adjoorned until two o'clock. Afternoon Session —After tho opening of tho Court, Mr; George P Hamilton read in erideoco the pardon granted by Gov. Bigler to Al.rolaru Morns, D. H. Haren, David T. Davis, and D X Lawson. Mr. Jobn Hampton said tbo pardon did not .cover the offence for which they were convicted. •It Was defective iu three particular? • Itrsdltes that they were pardoned for no onenoo of which they were convicted at December term, 1853, whereas the party, by record Bbowo in evidence, were convicted at the March t-im 1004. ’ 2. That tbc pardon is for tho crime of consr' racy generally, nnd cannot bo applied to tin offence. 3. That tbc party were convicted and sent to the county jail for three months, to pay a fine r.f $lOO aud costs of prosecution, while the pardon only recjtcs that they were sentenced to three months’ imprisonment aud to pay costs. Tho record of the Quarter Sessions was tin u read by Mr. Hampton, and reference, to support, the position, made to the case of United States vs. Statler, 0 Pa. Legal Intel.; Fry's case, Whar ton’s State Trials, p. 687. Mr. G. P. Hamilton, in reply, contended that the pardon was explicit enough. It mado no difference at which term tbc party were convict ed, so long as the pardon showed what offence if was for. Mr. the matter was one of iden tity only. There must be such a degree of cer tainty as to preclude all possibility of doub'. The pardon appeared to be for an entirely differ ent offence from the one for which they wcr.t convicted. This irrelevancy cannot be supplied by construction of the Court, Mr. G. P. Hamilton offered in evidence the Record of tho December Term of Quarter Ses sions* 1853, to show that the party were not convicted of any offence at that term. This Mr. Williams objected to: Ut. Bceaue • the party is estopped by a recital of the offence of which they were convicted and pardoned, an 1 2d. That if the negative fact was Shown, it would only render tbo pardon inoperative. The Court overruled tho objections to tho par don, which was admitted ob evidence, subject to the opinion of the Court on pcints reserved.' The deposition of Absalom Morris was again offered in evidence. Objected to by Mr. Williams, at some length, because: 1. The evidence givea by himself therein discloses an interest on his point which has cot been divested, or if discharged by tbo alleged cancellation of the paper by which it way evidenced on the very eve of his examination, and with thcadvice of the plaintiff's counsel, was obviously got rid of for the purpose of enablin'- him to testify in the case. 2. The testimony in regard to the passing of the email cotes, alleged to have been paid out by defendants, is entirely second-hand, the same being based expressly upon a schedule compiled long afterwards by the clerk of the plaintiff’? attorney from the original endorsement asserted to bave been made upon the said notes, at or about the time of the passing thereof, and the notes themselves not having been produced for Identification by him. 8. The schedule referrod to by the witness, and appended to his depositien, is but a copy of the original memorandum made long afterwards, either to refresh tho memory of the witness, or as an item of independent and substantial evi dence. 4. There is no identification of the small notes referred to, or their endorsements, Qnd tho evi dence in relation thereto is incompetent withoat tbo production of tbo notes themselves upon tbo examination, no suggestion being made of their loss or destruction, and the notes tbemselveN being the best and only evidence of all that re fera to tbem. 5. That the evidence is irrelevant, qb showin« merely a violation of the law by sundry of th.- Bpecial agents of the defendants, at the instance and by the procurement of tho plaintiffs and th< witness, and without any evidence of authorit from the company. 0. That tho witness refused to answer a mn terial question put to him by the counsel of th> defendants. 7. That a large portion of the evidence of the witness is mere hcresoy. Mr. Hamilton replied at some length to the objections cf Mr. Williams. The Gonrt sustained the objections and reject ed the deposition. Mr. Hamilton begged to have the case con tinned, in order to have time to prepare a nev< deposition. This motion was subsequently with drawn. He then asked to have the case eus oDt *l this morniDg, in order to consol: with hia colleague as to what further action the\ would pursue. Court was accordingly adjourned. Burglary—The house of Mr. Ogden, on Penn street, .was entered by a burglar on Sunday mprning, between 2 and 3 o’clock. The nois; created by the entrance of the rascal awakened Mrs. Ogden, and she giving the alarm, he soon fled, taking with him in his flight a Bilver watch and a lot of clothing. The trial was entered upon for the purpose of proving that there was a conspiracy, and that defendant had been hired to firo the stable. The first witness called was High Constable Scott, of Allegheny, who testified to going to the stable of the prosecutor, on the nighi stated and secreting himself inside. Shortly after ho arrived there, Dickson came along, and ignited a cotton ball saturated with turpentine, with which he attempted to fire the building, when Scott jumped ont and arrested him. Mayor Adams testified that defendant, without inducement, after his arrest, had made a volun tary confession of the intended crime. (We published the confession at tho time of Dickson’s arrest.) Mr. Dilworth testified as to situation and own ership of the stable. Officer Long corroborated Mr. Scott’s test mooy. Samncl Hmsslon testified that he had known o/. The next witness called was a brother of Hues too. Ills evidence was of an unimportant char aotcr, and closed the testimony. At tho conclu sion, Col. Black commenced to address tho jury for the defence, and spoko until Court adjourned. Henry Ward Bf.eciieh's paper, the New York Independent, “thinks tbat the praotioe of audible assent to and the union in public prayer might he adopted without impropriety in Congregation al or Presbyterian ohurchos. There might bo opportunity given in the worship for the silent prayer each one for himself aod for his friends of all the congregation. Especially mibgt the Cord a Prayer have a permanent and prominent place in the puhlio worship of every ohurcb, all joining in It." We observe that this latterfeature has already been incorporated into the Bervlce of one of the non conforming churches of tbisc ty. The congregation of tho now Methodist Church on Penn street, repeat tho Lord’s Prayer after their pastor, it being introduced at tho end of the first prayer of the service. Although this prac tice is not usual in any denomination other than the Protestant Episcopal, yet it is by no means either oovc! or strange.
