But the manifest raisrep rosenCttions which have characterized tho dis cussion of this unpleasant ‘Controversy uncertain sections of the country, have indnced me to present a brief statement of the tacts of tho case; as a defence ot the State and lierrepresentatives. Hie Coimnomvealth lias had no controversy with the citizens or corporations of oOfUr States, lior has she been inclined to interfere with their' rights or Interests; or to unnecessarily interrupt the travel or commerce of the country. She has been dealing with a refractory creature of her own, which had most palpably “misused and abased ” the privileges conferred.upon it by law,' a corporation that had attempted tho usurpation of power, that had infringed the sovereignty of tho State, and invaded her rights of eminent domain. If in this contest she was brought into Collision with citizens and corporations of other States,tho difficulty was not of her own seeking, Tim vindication of her honor and dignity was a duty which she could not neglect j andl have! no hesitation in saying, without any reference! to the difficulties at Erie, that itwasright and politic on-tlio part of the State-to exercise the power which she had reserved over this corporation. > The act, I doubt not, will exert a wholesome influence in future, over the conduct of similar bodies. If neglected in a case so manifestly proper, it would bo idle to insert reservations and conditions in similar corporations fbr the protec tion of tho public, as it would also be useless! to grant additional railroad charters. Under such a latitudinnrian construction as cluimcd "by (ho Franklin Canal Company, these already in exis tence could occupy every feasible xonto in the State. : In 1844, tins corporation was created for tho i purpose; of improving the French crock division ! of tho Pennsylvania canal,' the State reserving. I tho ught to repossess; said canal, at any tirno ( thereafter, by: re-paying the company tho amount of money expended in its improvements, with six per cent interest. .. In April, 1849, the company was authorized to construct a railroad on: the,banks of said canat and to extend tho same from the head of the ca nal north to Erie, and south' to Pittsburgh; the. Legislature expressly, reserving tlio right; to re voke the charter of the company* should the privileges ;grantcd bo at nny time ‘.‘misused pr, abused.” Tho company made no attempt to itn'- 1 prove, said canal, nor to construet the railroad [from-the termini of the canal to Pittsburgh or i Erjo, In 1850, however, tboy: commenced-the i construction of: a railroad flora the Ohio State lino to tho city of,Erie, parallel, with the lake, and nearly at a right angle with the route assign ed to thorn by the Legislature, ....... . . t ;; . Theywere early, admonished against-this at tempt. In 1851,.the PittsburghandErierailroad company, instituted proceedings against-the Franklid canal company, in the Supreme County on the groiuid that they had no.nght to construct a road on the location, which they were attempt ing to occupy. J In the spring of 1852, tho Attorney General mado complaint, against said company before tho Supremo Court, in the name of the Common wealth, and prayed for an injunction to restrain the construction and use of said railroad. The i opinion of tho Court in this case,was delivered, t in January, TBSS, by Chief Justice Black) aifd i wliilst the injunction prayed for was refused on. I tho • technical ground, that the Commonwealth could not, under the law, give security for dama-> -ges, the views of the court litcfalry annihilated the rights of the company to construct a road on tho route which they were then occupying) and in •this opinion the Circuit Court of tho United States, at Pittsburgh,‘has folly conenrred.' ‘ : The .Legislature of 1855; repealed the law re quiring thm Commonwealth to; give security for damages, and thereby, removed tho dnly ohstacle i in theway of, a final decree against the company, •in the.case then pending, . There Is now a break of gauge at each, and Is it not strange that whilst tho latter citv haa complained,of Ene, it has faded to discover a similar obstruction to trade and travel m its own vicinity? When this shall havo been removed it will be time enough, it seems tor me, to complain of Pennsylvania. s To lHustrate this idea still more forcibly, sup pose it were possible to force that narrow strip of territory eastward for afetv miles; and permit New York and Ohio tocomc together at Erie, then where would he tlin break of ;raitrond:gauge, and who would bo at fault ? ; When tho capitalists df Now York commenced the construction of a rail-', road from the city of Buffalo westward, differing" in width from the other roads of that State, they had determined to imposo upon commerce tho inconvenience incident to a transhipment.— Solicitonaasl am to facxhtataintcrcourse between the great West and. the Atlantic cities, and to maintam a liberal poVicv towards neighboring States,tliave been unable to discover a. reason, in public poiic v, why this; unavoidable tranship ment should not occur at Eric. ' Such a position isnotwanting in courtesy or'kindness to onr n6ighbors. -New York lias selected her policy as -to. the-width Of railroads. She desires to extend them westward; and Pennsylvania-is willing! to admit thorn within her limits.' Ohio; on the oth er hand; deßires to get eastward, and Pennsylva nia oxtcndstO her an equal- degreo - of courtepy. Tho latterSfato asks no advantage; iheis willing to extend her roads to Erie, and meet New York and Ohio on equal terms, onher own territory!— Surely there con bo no want of conrtesv in this position. Howovor much she may regret the ne ccssityfor a tranriiipment, she has not the 1 power to obviate it. But, on the othorhand,lt is demanded .that a gauge of railroad, ;unsual to. Pennsylvaniae and New York both, with'Which neither canconnect, should extendfrom Ohio totho- city,-of Buffalo; on a line a mile and more south.of the harbor; of Erie, and cutting.off the. chances;of connection with the.Sunbnry and Erie, m tho former State, and tho New York: and Erie railroad,. in the lat ter.- -Tins arrangement may,answer 'the -owners of the road belter than Ihopublic. It has been assigned as areason for this policy,- that Buffalo is a greater city than Erie—that the former should be regarded as the eastern termini of the-western business. ■ Atlantio cities will scarcely be willing to adopt this idea. .■ c -. -. t .lybowevcr; regard tho .connection of this Lake -Shore, road, and, the.Sunbury andXrio.aud.the ; Pittsburgh and Erie railroad with tho lake, at the harbor of Erio, as vastly-more important to tho i State,and fbo city of Erie than the termini of. the gauges. -The harbor at Erie is one of the safdst on the lake, and its other natural advantages are not surpassed. It can be connected withr the At lantic cities by a shorter and better railroad corn-' municatiob than any other, and it needs hut tills, to place it in possession of an. immense business. 1 But it wilt bo vain to anticipate the accumulation of tho vast products of tlie country iothathsr boY,"unless facilities bo affordedto'tntnsportaiion to and from it; Nor Is it any niofo reasonable to present the.condlhonof business in-tho harbor, at this time, as an argument against the construc tion of sach facilities. It-would he as sensible •to expect to discover t\dl grown corn In-the un cultivated forest,- as to-flnd the' ‘vast products bf. the country in a harborfrom which -there is no means of transit. - The natural advantages of fhis harborhavo been thus-far rudely rejected ; but this policy,-I am confident, cannotbe longermaib talned. The increasing business of -the - country will demand the use of this eligible spot as a ne cessity j as lam also confident, the connection of I the lakes with Philadelphia by railroad,-will dis tinguish an era of renewed - growth and: greater prosperity to the city of Erie and the surrounding Country. 1 I i have approached the .discussion of this sub-1 ject, with much reluctance, because of.the ,un-1 pleasant feehngs which ,it has excited in certain sections of the country. , 1,, have .only, been con- ; strained to do so by a sense of duty to tho State in her sovereign capacity.
