Counsel: Stowe for Dougherty ; Cochran and Shinn for Warfield. ■ - Dougherty testified that on the 4th of February a boy esme ap to the Mayor’s office and* said (hat the presence of the police was required on the leyee; Marcellas, end he went down ; there ap peared to bo considerable excitement between War field and another man; Warfield was on the steam er' Cincinnati, and in order to get tbo difficulty set . tied, witness thought it best to take all the parties to the Mayor*!'office. Warfield resisted, and took a large knife from the cook house, and swore he Would., cut witness 1 heart out if ho attempted to ' take him j but witness finally induced him to go to the Mayor’s office. - Dougherty was corroborated in his statements by another witncaa. 'Warfield’s version was somewhat different.
